HomeMy WebLinkAboutCity Council Resolution 1971-348BEXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF PLYMWTH, MINNESOTA Pursuant to due cell and notice thereof, a special meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 30th dei► of September 1971, at 7:20 P.M. at the Beacon Heights Elementary Sehool, 12315 Highway x`55, Minneapolis, Minnesota. The fbllowring members were present: Magor Hilde, Councilmen Hintz, Spaeth and Hunt. The following member was absent: Councilmen Johnson. e KKK e Couuncilmen,Hintz introduced the following Resolution and moved Its adoption: RESOLUTION NO. 71-348-B (Levy 5319) A RESOLUTION CONFIRMING & ADOPTING THS ASSESSMENT FOR STREET LIGHTING IN CREEKWOOD HEIGHTS ■i1EREAS, pursuant to due and proper notice according to law an assessment hearing was held on the 30th day of September 1971 relating to street lighting costs for Creekwood Heights Addition, and NfIIMW, all persons present desiring to be heard were heard and their objections, if any, were noted. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMDUTH, MINNESOTA, AS FOLLOWS: "1. The acting Village Clerk has, with the assistance of the Village Finance Director heretofore selected bF this Council for such purpose, calculated the proper amcuats to be specially assessed for street lighting in Creekwood Heights Addition against every assessable lat, piece or':parcel of land, in accordance with the provisions of law, and has prepared and filed in thin office tabulated statements in duplicate slowing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the owns. 2; Notice has been duly published as required bar law that this Council would meet in regular session at this time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons inter- ested, and an opportunity has been given to all interested persons to present their objections, if any, to such pro- posed assessment, or to any item thereof, and no objections have been filed. (Resolution No. 71-348-H) 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefitted by the construction of such street lighting in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. S. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessments fbr each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed ehall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assess- ment for street lighting costs fbr Creekeood Heights Addition. 7. The amounts assessed against each lot, piece or parcel of land shall bear,interest from the date hereof until the same have been'paid at the rate of zero percent per annum. S. Such assessments shall be payable in one equal annual Installment payable on the first dear of January in each year, beginning in the year 1972, and continuing until all of said installments shall have been paid, each in- stallment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment f5nom the date hereof to December 31, 1971 . To each subsequent In- stallment shall be added interest fbr one year on all unpaid installments. 9. The Village Clark is hereby directed to make up and file In the office of the County Auditor of Hennepin County a certifed statement of the amount of all of such unpaid assessments and the amount wbioh will be due thereon the first day of January in each year." The above motion was seconded by Councilman Hent and upon vote being taken thereon, the following voted in favor thereof: Mewor Hilde, Councilmen Hintz, Spaeth and Hunt. No one voted against.
