HomeMy WebLinkAboutCity Council Resolution 1971-317VILLAGE OF PLYMOUTH Pursuant to due,call and notice thereof, a regular meeting of the Village Council of the Village of Plymouth, Minnesota was held on the 13th day of September, 1971. The `following members were present: Mayor Hilde, Councilmen Johnson, Hintz, Spaeth, and Hunt. The following members were absent: None. Councilman Hunt introduced the following Resolution and moved its adoption: RESOLUTION NO. 71-317 A RESOLUTION WAIVING THE REQUIREMENT OF SECTION 462.358 SUBDIVISION 4, MINNESOTA STATUTES AND SECTION 9.02 OF CHAPTER VII OF THE VILLAGE CODE RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES WHEREAS. Parkers Lake Baptist Church has requested than an existing pracel located at 14720 County Road 6 be further subdivided, and WHEREAS, the Village Council has determined that the subdivision of land into two,parcels both of which would contain less than five (5) acres would notinterfere with the purposes of the Subdivision Regulations of the Pillage of Plymouth and that a refusal to permit such subdivision would create an unnecessary hardship on such owner, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH as follows: 1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota Statutes and Section 9.02 of Chapter VII of the Village Code relating to conveyances by metes and bounds of parcels of land containing an area of less than five (5) acres is hereby waived with respect to the following described parcels: PARCEL A That part of Government Lot 2, Section 28, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Beginning at the intersection of a line drawn at right angles to the West line of said Government Lot 2 from a point thereon distant 694.27 feet South along said West line from the Northwest corner of said Government Lot 2, with the East line of said Government Lot 2; thence Most along said right angle line to its intersection with a line drawn parallel with and 1020 feet East measured at right angles from the West line of said Government Lot 2; thence at a right angle South to the centerline of County Road No. 6; thence West along said centerline to its intersection with a line drawn parallel with and 820 feet East, measured at right angles from the West line of said Government Lot 2; thence South parallel with the West line of said Government Lot 2 to the Southerly line of said Government Lot 2; thence Easterly along said Southerly line to the East line of said Government Lot 2; thence North along said East line to the point of beginning; except all that part thereof lying South of the Northerly line of Hennepin County State Aid Highway Number 6, Plat 5 on file and of record in the Registrar of Titles, Hennepin County. Minnesota. Also Lots 9 and 10, Block 1, Rath's Second Addition, Hennepin County, Minnesota. PARCEL B Commencing at the Northwest corner of Government Lot 2; thence East to the Northeast corner thereof; thence South to the Southeast H corner thereof; thence West along the South line of said lot to the Ei East line of. Block 2 Rath's Second Addition; thence North along said East line and extension thereof to the North line of County Road No. 6; thence Southeasterly along said road line to the Southeast i corner of Block 1 of said Addition; thence North to the Northeast corner thereof; thence West along the North line and its extension thereof to the center line of Town Road; thence Northwesterly and Northerly along said road line to beginning, except beginning atthe intersection of a line drawn at right angles to the West line of �1 said Government Lot 2 from a point thereon distant 694.27 feet South along said West line from the Northwest corner of said Goirernaknt Lot 2;'with the East line of said Government Lot 2; thence West along !' said right angle line to its intersection with a line drawn parallel with and 1020 feet East measured at right angles from the West line of said Government Lot 2; thence at a right angle South to the center- line of County Road No. 6; thence East along said centerline to the East line of Government Lot 2; thence North along East line to the point of beginning, j 2. The Village Clerk is directed to prepare a certified copy of this Resolution for recording purposes. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth, and upon vote being taken thereon. the following voted in favor thereof: Mayor Hilde, Councilmen Spaeth, Hunt. Hintz, and Johnson. The following voted against or abstained: None. Whereupon the Resolution was declared duly passed and adopted. STATE OF MINNESOTA COUNTY OF HENNEPIN SS.
