HomeMy WebLinkAboutCity Council Resolution 1971-241EXTRACT OF MINUTES OF A REGULAR MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOOUTH, MINNESOTA Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Plymouth was '.field on June 21, 1971 at the Village Council Chambers, 14900C 23rd Avenue North, Minneapolis, Minnesota, commencing at 7:30 o'clock p.m. The following members were present: Mayor Hilde, Councilmen Hintz, Johnson, Hunt and Spaeth. The following members were absent: None. Councilman Johnson introduced the following resolution and moved its adoption: RESOLUTION NO. '71-241 A RESOLUTION RELATING TO PLANNING COMMISSION AND VILLAGE.COUNCIL PROCEDURES WHEREAS, the Planning Commission of the Village of Plymouth has been designated as the planning agency of the Village pursuant to and in accordance with the State Planning Aet Sections 462.351 to 462.364 . inclusive, Minnesota Statutes, and, WHEREAS, said Planning Commission in the course of its duties conducts public hearings,on requests for changes in zoning and other matters which require public hearings before the planning agency and in addition review and makes recommendations to the Village Council with respect to development and site plans and numerous other matters affecting Village planning, and WHEREAS, it is the desire of the Village Council that when it received from the Planning Commission its various reports and rec- ommendations that 3t be in a position to properly consider and make judgments with -respect to the requests of various applicants and petitioners who are seeking approval of their respective petitions in the area of Village planning and zoning, and WHEREAS, from time to time changes are made in the proposals made by developers and subdividers after such proposals have been considered by the Planning Commission but before they have been considered by the Council, and 1 i WHEREAS, it is deemed desirable and necessary that the Village Council have the benefit of the Planning Commission's judgment with respect to such prposals as they may have been changed and modified t3 following their presentation to the Planning Commission, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL i OF THE VILLAGE OF PLYMOUTH AS FOLLOWS: F 1. Whenever a public hearing is held before the Planning 4 Commission pursuant to ordinance with respect to the �i request of a subdivider, developer or other applicant and whenever said subdivider, developer or other appli- cant has modified or altered his request or proposal ;y following the presentation at such public hearing, it ii shall be required that the Planning Commission hold an- other public hearing on such altered or modified pro- posal, if in the view of the Village Planner such alter- ations or modifications are deemed to be substantial. 2. In the event that the Planning Commission after the con- duct of a public hearing on the request of a subdivider, developer or other applicant has determined that it can- not recommend the proposal without certain changes and adjustments therein and thereafter said subdivider, dev- eloper or other applicant makes alterations or modification to the propos for the purpose of securing the approval n of the Planning Commission then it shall be deemed to be the policy of this Council that the Planning Coxmission +, shall hold another public hearing on the matter to con- { aider the total proposal as modified or altered whenever { in the view of the Village Planner such alterations or tP modifications are substantial. 3. Whenever the Planning Commission has, in situations r-here i no public hearing is required, denied in whole or in part the proposal of a subdivider, developer or other i, applicant and thereafter said subdivider, developer or i other applicant has altered or modified his proposal prior to its presentation to the Village Council it shall { be deemed to be the policy of the Village Council that said altered and modified proposal shall be re-referred by the Village Planner to the Planning Commission for its further consideration of such alteratiLms and modifications before such proposal is presented for approval to the Village Council. 4. Copy of this resolution shall be mailed to all deve'i'opc.rs P� known to be engaged in business within Plymouth, alga additional copies made available in the Village hall for the purpose of dissemination to everyone who may be affected and a copy also made available to all Homeowner Associations within Plymouth." f The above motion was seconded by Councilman Hunt and upon vote I being taken thereon the following voted in favor thereof: Mayor Hilde, { Councilmen Hintz, Johnson and Hunt.
