VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH
May 3, 1971

Pursuant to due call and notice thereof a regular
!meeting of the Village Council of the Village of Plymouth was
held on May 3, 1971 at the Public Works Building, 14900 23rd
Avenue North, commencing at 7:30 P.M. The following members
were present: Mayor Hilde, Councilmen Johnson, Hintz, Spaeth
and Hunt.
The following members were absent: Nore

Counci]nan sp,oth introduced the following resolu-
tion and moved its adoption:
"RESOLUTION NO. 7,..17-,
A RESOLUTION AUTHORIZING THE USE OF EMINENT DOMAIN
TO ACQUIRE TEMPORARY EASEMENTS FOR STREET CONSTRUCTION
PURPOSES IN CONNECTION WITH UPGRADING OF FERNBR00K
LANE NORTH OF STATE HIGHWAY #55, PROJECT 70-1,0,8-A.
BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH:
1. It is hereby determined to be necessary, proper
and expedient and in the interest of the public
health, convenience and general welfare of the
citizens of the Village of Plymouth to acquire
temporary easements (for roadway construction
purposes or utility purposes or whatever) the
property described in schedule "A" attached
hereto, located within the Village of Plymouth,
County of Hennepin, State of Minnesota.
2. The Mayor and Village Attorney of the Village of
Plymouth are hereby authorized to acquire the
necessary lands for the aforementioned purposes
and to take any and all legal steps necessary
to such proceedings."
The above motion was seconded by c'oimcil
and upon vote being taken the following voted in favor thereof:
:'ayor Hilde, Councilmen Johnson, SnneLh and Ni.ntz.
The following voted Tgad-nst abstained: Councilman t'unr.
Whereupon the resolution was declared duly passed and
adopted.

I, the undersigned, being the duly qualified Village Clerk
of the Village of Plymouth, Minnesota, hereby certify that I
have carefully compared the attached and foregoing Extract of
Minutes of Regular Meeting of the Village Council of the
Village of Plymouth held May 3, 1971, with the original thereof f.,.
on file in the Village office and the same is a full, true and
complete transcript therefrom as the same relates to authoriz-
ing the use of eminent domain to acquire temporary easements
for street construction purposes in connection with upgrading
of Fernbrook Lane North of State Highway #55, Project 70-1,0,8-A.
