MEETING OF VILLAGE COUNCIL OF
VILLAGE OF PLYMOUTH, MINNESOTA
April 26, 1971
Pursuant to due call and notice thereof a special meeting
of the Village Council of the Village of Plymoutt: was held on
April 26, 1971 at the Council Chambers, 14900 C 23rd Avenue
North, Minneapolis, Minnesota, commencing at 7:30 o'clock p.m.
The following members were present: Mayor Hilde, Councilmen
Hintz, Johnson, Hunt and br3eth. The following members were
absent: None.
Mayor Hilde introduced the following resolution and moved
its adoption:
"RESOLUTION NO. 71-161
E, A RESOLUTION DIRECTING THE VILLAGE
STAFF TO PROCEED WITH THE NEGOTIATIONS FOR
THE ACQUISITION OF RIGHT OF WAY ON NIAGARA
LANE
WHEREAS, the Village Council has previously determined and
i directed that a portion of Niagara Lane,North of County Road No.
6, be relocated and widened and,
WHEREAS, said Council has approved the realignment prepared
by the consulting engineer and,
WHEREAS, said realignment requires the acquisition of
property from the City of Minneapolis, which property is awned
by said City of Minneapolis in connection with their ownership
and use of the Minneapolis Workhouse and,
WHEREAS, it is desirable that the Village of Plymouth
acquire this right of way by negotiation with the City of
Minneapolis,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF PLYMOUTH AS FOLLOWS:
1. The Village Manager is directed to proceed with
;! negotiations with the City of Minneapolis for the j
acquisition of right of way for the realignment !
of Niagara Lane, North of County Road No. 6,using

such Village staff personnel as he may deem
necessary.
2. The Village Manager is likewise directed to
prepare alternate assessment plans for the costs
of the realignment and construction of Niagara
Lane including the area designated as parkway
which plans would include the assessment of the
entire project including right of way costs for
the entire area surrounding Niagara Lane and which
might be benefited thereby. Such plans shall
be prepared so that they fairly and equitably spread
the proposed assessments to all benefited areas."
The motion for the adoption of the foregoing resolution
was seconded by Councilman Spaeth and upon vote being takan
thereon the following voted in favor thereof: Mayor Hilde,
Councilmen Hintz, Johnson, Hunt and Spaeth. The following voted
against: None.
Whereupon said resolution was declared duly passed and
adopted.

I, the undersigned, being the duly qualified and acting
Village Clerk of the Village of Plymouth, Minnesota, hereby
certify that I have carefully compared the attached and fore-
going extract of minutes of a special meeting of the Village
Council of said Village held April 26, 1971 with the original
thereof on file in my office and the same is a full, true and
complete transcript therefrom insofar as the same relates to
directing the Village 'staff to proceed with the negotiations for
the acquisition of right of way on Niagara Lane.
