HomeMy WebLinkAboutCity Council Resolution 1971-063y VILLAGE OF PI+ MOUTH J{I Pursuant to due call and notice thereof, a regular meeting of the Village Counci.l'.of the Village of Plymouth, Minnesota was held on the j 22nd day of February, 1471. The following members were present: { Mayor Hilde, Councilmen Johnson, Hintz, Spaeth and Hunt. No one was . absent. Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 71-63 WHEREAS, Tom Teigen•represeniing BelMar Builders, 3131 N. Fernbrook it Lane, requested a Conditional Use Permit for a recreational facility t! and placement of a restored railroad car on the Fox Meadows site. if NOW THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH: a f Approval is hereby given for a'Conditional Use Permit to Bel Mar �• Builders, Inc. for a recreational facility and restored railroad car { for a conference room in the Fox Meadows Office Park subject to the 1 following: i 1. The rail car, shall be securely affixed to the calls upon which it rests in a manner .as approved by the Village Engineer and Building Inspector. ( 2. Landscaping around the rail car shall be completed within 1t three months of the issuance of the.Special Use Permit. ' 3. If after the rail car has been erected, the Village Council i determines that it endangers the general welfare, health,» safety or morals of the residents of the Village ,of Plymouth, i or depreciated the values of the land or structures within { the Village of Plymouth, this Special. Use Permit shall be- come null and void, and the railcar shall be removed within �. thirty (30) days of the date of such determination. 4. The owner shall maintain the rail car in a good =and safe condition and if the Building Inspector finds that the car is unsafe. or not being property maintained, he shall give {� written notice of. this fact to .;ie owner who has ten (10) days to comply with thin notice or the Special Use Permit �± will become null and void, and rhe veil car shall be re- moved within thirty (30) days of what date. 5. There shall be no comriercial sale of foot' or beverages in the rail car. i #. 6. As a Type 5 non -fire rated building it vigil be required that this building be located a minimus di3tance of forty (40),feet from any other structure and comply with all it village setbacks. A certified survey.is required indicating the location of the building and 'elevations_and complete building {. plans for the handball court including mechanical and electrical plane. 8. The above structure shall include toilet facilities. The motion for the adoption of the foregoing Resolution was duly .P seconded by Councilman Johnson which includes an amendment -made by ,i ( Councilman Spaeth ,and second by Councilman Hunt and upon vote being II taken thereon, the following voted in favor thereof; Mayor Hilde, Councilmen Johnson, Hintz, Spaeth and Hunt.
