HomeMy WebLinkAboutCity Council Resolution 1971-039Pursuant to due call and notice thereof a special meeting
of the Village Council of the Village of Plymouth was held on
the 25th day of January, 1971 at the Village Council Chambers at
14900 C 23rd Avenue North commencing at 7:30 o'clock p.m. The
following members were present: Mayor Hilde, Councilmen
Johnson, Hintz, Spaeth and Hunt. The f..1lowing were absent:

Councilman Johnson introduced the following
resolution and moved its adoption:
"RESOLUTION NO 71-39
A RESOLUTION PERTAINING TO AND APPROVING
THE COST ALLOCATIONS FIXED BY THE BASSETT
CREEK FLOOD CONTROL COMMISSION RELATING TO
THE SHELARD PARK DRAINAGE PROBLEM
WHEREAS, by virtue of the development of and construction
in the area known as Shelard Park in the City of St. Louis Park
the drainage of surface waters in and through the Village of �
Plymouth and the Cities of St. 'Louis Park and Minnetonka was ^
significantly affected and,
WHEREAS, the City of St. Louis Park has been seeking
financial contributions from the Village of Plymouth and the
City of Minnetonka for the cost of developing a storm sewer
system to alleviate said drainage problems and,
WHEREAS, said communities were unable to themselves
agree upon a cost sharing formula for said storm sewer system
and,
WHEREAS, all of said communities are members of the Bassett
Creek Flood Control Commission and,
WHEREAS, the Bassett Creek Flood Control Commission agreed
! that it would study the problem and make recommendations to the

said communities for the allocation of costs among said
communities for such storm sewer system and,
WHEREAS, on the 19th day of November the Bassett Creek i
Flood Control Commission did adopt the report and recommendations
of its Shelard Park Cost Allocation Committee and that said
report and recommendations proposed that the costs of said
storm sewer system be allocated as follows:
City cf St. Louis Park $351,439
City of Minnetonka 47,808'
Village of Plymouth 11,997
Minnesota Highway Department 65,225
$476,469 and,
WHERAS, the Village Council of the Village of Plymouth has
studied said report and recommendations and has received further
information with respect thereto from its representatives on said
commission as well as from its professional engineers and,
WHEREAS, the said Village Council does not agree with the �.
recommendations of the said Commission that the ;concept of
credits for "agricultural runoff" not be used in allocating the
costs of the project and therefore by this resolution does not
abandon, waive or surrender any rights or opportunities to urge,
and propose the use of such concept in any future allocations
of similar projects affecting said Village and,
WHEREAS, notwighstanding its objections to said finding and
recommendations of the said Commission the Village Council of
the Village of Plymouth desires to cooperate in a reasonable and

forthright manner with its neighbors in the solution of common
problems.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL I
OF THE VILLAGE OF PLYMOUTH AS FOLLOWS:
1. The report and recommendations of the Bassett
;i Creek Flood Control Commission relating to cost allocations ( ,'
for the Shelard Park Storm Sewer System are hereby
accepted and the Village of Plymouth hereby agrees to pay
as its share of such costs the sum of $11,997 plus
2.6% of the engineering expenses involved in the }j study by the Bassett Creek Flood Control Commission subject to the
following conditions:
l' a. The Village of Plymouth does not surrender,
waive or abandon its position that credit shoo d
!! be given in such allocations to the concept ,
'f of agricultural runoff and this resolution
is without prejudice to the right of the
Village of Plymouth to renew said position
in the future.
b. Payment of the sums set out above..shall not
be required of the Village of Plymouth unitl a.
reasonable period of time isgivensaid
Village to determine and arrange the method
or methods of financing said payment.
2. The Village Manager is hereby directed to furnish
•.� a certified copy of this resolution to the chairman of the
? Bassett Creek Flood Control Commission and to the
representative and alternate representative of the Village
of Plymouth to said Commission."
i! The above motion was seconded by Councilman.Hintz
and upon vote being taken thereon the following voted in favor
i! thereof: Mayor Hilde, Councilmen Hintz, Johnson, Hunt and
Spaeth. The following voted against: None.
Whereupon said resolution was declared duly passed and
adopted.
