GREEMENT WITH ANADIAN ACIFIC AILWAY FOR THE ICKSBURG ANE
REP(16001)
ECONSTRUCTION AND XPANSION ROJECT
WHEREAS, plans and specifications have been prepared for the Vicksburg Lane
Reconstruction and Expansion Project between Schmidt Lake Road and the Maple Grove border
in the City of Plymouth and said plans and specifications have been presented to the Council for
approval; and
WHEREAS, permanent and temporary easement needs have been identified, appraisals
have been prepared by an independent appraiser and offers were submitted to the property
owners by November 2, 2015; and
WHEREAS, some offers were accepted, some negotiated and settled and some
properties are now subject to condemnation and a deposit must be made to District Court; and
WHEREAS, the City desires to replace an existing at-grade crossing and install a grade-
separated crossing over the Canadian Pacific (CP) Railway; and
WHEREAS, an agreement with CP Railway has been prepared in which the City shall pay
for all costs associated with construction of the grade-separated crossing and CP Railway shall
reimburse the city in the amount of $250,000,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1.Such plans and specifications, copies of which are on file in the City Engineer’s office and
made a part hereof, are hereby approved.
2.The City Clerk shall prepare and cause to be inserted in the official paper and in
Minneapolis Builders Exchange an advertisement for bids upon the making of such
improvement under such approved plans and specifications. The advertisement shall be
published twice, shall specify the work to be done, shall state that bids will be received by
the City Clerk until 10:00 a.m. on January 21, 2016, at which time they will be publicly
opened in the City Council Chambers of the Plymouth City Center building at 3400
Plymouth Boulevard, Plymouth, Minnesota, by the Engineer and City Clerk, will then be
tabulated, and will be considered by the council at 7:00 p.m. on February 9, 2016, in the
City Council Chambers. Any bidder whose responsibility is questioned during
consideration of the bid will be given an opportunity to address the City Council on the
issue of responsibility. No bids will be considered unless sealed and filed with the City
Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check
payable to the City Clerk for five percent of the amount of such bid.
3.Approves right-of-way payments for the Vicksburg Lane Reconstruction and Expansion
Project, City Project No. 16001.
4.That the Mayor and the City Manager are authorized to execute all documents necessary,
in the opinion of the City Attorney, to effect the acquisition of the necessary fee title
and/or easements.
5.That the agreement with CP Railway has been approved and the Mayor and City
Manager are authorized to execute the agreement and any amendments to the
agreement.
