HomeMy WebLinkAboutCity Council Resolution 2015-348 CP ITY OF LYMOUTH RN.2015-348 ESOLUTION O RAPFPV ESOLUTION PPROVING A RELIMINARY AND INAL LAT AND ARIANCE FOR “SA”PL9905NL OUTHSHORE DDITION FOR ROPERTY OCATED AT ATHAN ANE (2015098) WHEREAS, South Shore LLC. has requested approval of a preliminary and final plat and variance for the roughly 4.5-acre parcel presently legally described as Tract C, Registered Land Survey 1376, Hennepin County, Minnesota; and, WHEREAS, the Planning Commission has reviewed said preliminary plat request at a public hearing and recommends approval, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by South Shore, LLC. for a preliminary and final plat and variance for “Southshore Addition”, subject to the following conditions: 1.A preliminary and final plat is approved to allow the property to be subdivided into two lots, one for each of the two existing industrial buildings, in accordance with the application and plans received by the city on October 22 and 23, 2015 and November 20, 2015, except as may be amended by this resolution. 2.A variance is approved to allow Lot 1 to have 86.2 percent impervious surface coverage and Lot 2 to have 91 percent where the ordinance allows a maximum of 25 percent, in accordance with the plans received by the city on October 22 and 23, 2015 and November 20, 2015, with the finding that the proposal complies with all applicable variance criteria. No other variances are approved or implied. 3.Prior to recording the final plat, the applicant shall submit a draft copy of the private easements and/or covenants to be recorded against the property to ensure cross access and maintenance for the shared driveways and private drives, parking, hydrants, watermain, and other shared improvements. 4.The applicant shall submit proof of recording for the following: a) the plat and b) the private easements/covenants. 5.Future expansions or alterations of the buildings are subject to additional reviews and approvals. 6.This approval shall expire two years after the date of approval, unless the applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
