HomeMy WebLinkAboutCity Council Resolution 2015-327 CP ITY OF LYMOUTH RN.2015-327 ESOLUTION O RAVSR--W ESOLUTION UTHORIZING THE ACATION OF TREET IGHTOFAY OA,GOPA WITHIN UTLOT ROVES FFICE ARK DDITION SE1/4NE1/4,S36-118-22 AND THE OF THE ECTION D&UE AND ALL RAINAGE TILITY ASEMENTS WOA,GOP2A ITHIN UTLOT ROVES FFICE ARK ND DDITION WHEREAS, a public hearing with respect to said vacation was scheduled for November 24, 2015, in accordance with Minnesota Statutes 412.851 and City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of November 24, 2015; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the City Council did hold a public hearing on November 24, 2015, to inform any and all interested parties relevant to the vacation of Street Right-of-Way within Outlot A, Groves Office Park Addition and the SE 1/4 of the NE 1/4, Section 36-118-22 and all Drainage & Utility Easements within Outlot A, Groves Office Park 2nd Addition; and WHEREAS, it was determined by the City Council that said street right-of-way and easements are not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That street right-of-way within Outlot A, Groves Office Park Addition and the SE 1/4 of the NE 1/4, Section 36-118-22 and all drainage & utility easements within Outlot A, Groves Office Park 2nd Addition described as follows, be vacated: Street Right-of-Way That part of Nathan Lane North, as dedicated on the plat of GROVES OFFICE PARK, according to the recorded plat thereof, Hennepin County, Minnesota, lying easterly, northerly, easterly and southerly of the following described line: Commencing the northeast corner of Outlot A, GROVES OFFICE PARK , according to the recorded plat thereof, Hennepin County, Minnesota, thence North 89 degrees 31 minutes 00 seconds West, along the north line of said Outlot A, for a distance of 770.91 feet to the easterly right of way line of said Nathan Lane North and the point of beginning of the line to be described; thence South 00 degrees 24 minutes 17 seconds East, for a distance of 1.43 feet; thence southerly, along a non- tangential curve, concave to the west, having a radius of 60.00 feet, a delta angle of 162 degrees 19 minutes 34 seconds, for an arc distance of 169.99 feet, a chord bearing of South 03 degrees 15 minutes 45 seconds West, a chord distance of 118.58 feet to the southerly right of way line of said Nathan Lane South and the point of termination. Together With The east 36 feet of the south 258.00 feet of the north 691.50 feet of the west 320.00 of the east 337.00 feet of the Southwest Quarter of the Northeast Quarter of Section 36, Township 118, Range 22. Together With That part of 9th Avenue North, as dedicated on the plat of GROVES OFFICE PARK , according to the recorded plat thereof, Hennepin County, Minnesota, lying westerly of a line drawn from the intersection of the northerly right-of-way line of said 9th Avenue North and the east line of Outlot A, GROVES OFFICE PARK 2ND ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota to the intersection of the southerly right-of-way line of said 9th Avenue North and the east line of said Outlot A. Drainage and Utility Easements All Drainage and Utility Easements and Drainage Easements for Ponding Purposes lying within Outlot A, as created by and dedicated on the plat of GROVES OFFICE PARK 2ND ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintain the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof. FURTHER, that the recording of this resolution shall be recorded with, but prior to the recording of Groves Office Park 3rd Addition plat. Approved by the City Council on this 24th day of November, 2015.
