A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN ADULT DAYCARE FOR
COMMUNITY CONNECTIONS PARTNERSHIP FOR PROPERTY LOCATED AT 3431 STATE
HIGHWAY 169 (2010037)
WHEREAS, Community Connections Partnership has requested approval of a
conditional use permit for the site legally described as follows:
Lot 3, Block 2, Glen Erie Addition, County of Hennepin, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by Community Connections Partnership for a conditional use permit to allow
an adult daycare in the existing multi -tenant building located at 3431 State Highway 169, subject
to the following conditions:
1. A conditional use permit is approved to allow a 2,700 square foot daycare within the
existing building, in accordance with the application and plans received by the city on April
27, 2010, except as may be amended by this resolution.
2. The conditional use permit is approved with the finding that all applicable conditional use
permit standards are met, as follows:
a) The applicant's proposed daycare use would be consistent with the C (commercial) land
use designation.
b) The applicant's proposed daycare use would not be detrimental to or endanger the public
health, safety, morals, or comfort.
c) The use would not be detrimental or injurious to the development of other properties in
the area as the properties are fully developed. The site has adequate parking for the
daycare and the additional tenant space.
d) The site is served by public sewer and water and has its access from an improved, public
street.
e) With the conditions in this resolution, the application is consistent with the specific
standards for daycares that would apply to this application, including requirements that
the daycare: 1) have access to city sewer and water; 2) have access to adequate off-street
parking and loading areas; 3) have signage consistent with city requirements; and 4)

obtain a license from the State of Minnesota and remain in compliance with state
requirements.
3. Prior to construction of tenant improvements to or within the building, the applicant
must obtain separate approval of a building permit.
4. Prior to occupancy of the tenant space, the applicant shall furnish a copy of the permit
issued by the State of Minnesota for the daycare.
5. Standard Conditions:
a. Any signage shall comply with the city's sign regulations.
b. All waste and waste containers shall be stored within approved designated area.
c. Subsequent phases or expansions are subject to required reviews and approvals per
ordinance provisions.
d. This approval shall expire one year after the date of approval, unless the property owner
or applicant has started the project, or unless the landowner or applicant has received
prior approval from the city to extend the expiration date for up to one additional year, as
regulated under Section 21015.07 of the zoning ordinance.
