HomeMy WebLinkAboutCity Council Resolution 2010-145CITY OF PLYMOUTH RESOLUTION No. 2010-145 A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT FOR THOMAS AND DEBORAH VANDERHEYDEN FOR THE "MARGARET SWANSON ADDITION" FOR PROPERTY LOCATED AT 820 LANEWOOD LANE (2010022) WHEREAS, Thomas and Deborah Vanderheyden have requested approval of a preliminary and final plat for the roughly one -acre parcel presently legally described as follows: Lot 1, Block 4, CHRISTIANSEN' S PARKER'S LAKE THIRD ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Thomas and Deborah Vanderheyden for a preliminary and final plat for Margaret Swanson Addition, subject to the following conditions: 1. A preliminary plat and final plat are approved to allow the property located at 820 Lanewood Lane to be subdivided into two single-family lots, in accordance with the application and plans received by the city on March 4, 2010, except as may be amended by this resolution. 2. In conjunction with any fiiture City of Plymouth street reconstruction project within this neighborhood, a cul-de-sac turn -around would be constricted within the existing 60 -foot wide right-of-way for 9"' Avenue abutting the subject site. Prior to recording the final plat with Hennepin County, the applicant shall revise the final plat drawings to indicate no dedication of public right-of-way within the plat. 3. In conjunction with recording of the final plat, the applicant shall provide the City with a ten - foot wide easement for snow storage purposes along the northerly boundary of the plat. Prior to recording the final plat, the applicant shall pay the park dedication cash fee in lieu of land dedication, in accordance with the dedication ordinance in effect at the time of filing of the final plat. 5. Prior to recording the final plat, the following area assessments shall be paid: a. Watermain area charges based on 0.56 acres multiplied by $3,525 per acre = $1,974.00. b. Sanitary sewer area charges based on 0.56 acres multiplied by $950 per acre = $532.00. 6. The applicant shall obtain the necessary permits and approvals as follows: City of Plymouth for any work within the public right-of-way and Bassett Creek Watershed. 7. Prior to recording the final plat, the applicant and landowner shall agree to be assessed for the two lots within this plat for any fiiture street reconstruction project. 8. Prior to recording the final plat, the applicant shall revise the overall plat and plans as follows: a. Indicate silt fence locations. b. Indicate sewer and water service locations. C. Provide detail for saw cut area in Lanewood Lane where sewer and water service connections would be made. d. Provide standard drainage and utility easements, with an additional five feet along the south lot line of proposed Lot 1 for the extension of sanitary sewer and water services to serve proposed Lot 2. e. Add a clean out for the sanitary sewer at the west boundary of proposed Lot 1. f. Provide a note on the plans stating: The contractor shall contact the city sewer and water department at (763) 509-5950 a minimum of 48 hours prior to any public sewer/watermain connection. g. Provide a note on the plans stating: The 2010 City of Plymouth Engineering Guidelines and Standard Specifications shall apply. h. Show how the proposed driveway for the new home would connect to existing pavement in 9t1' Avenue. i. Indicate the cul-de-sac turn -around as fi ture constriction by others. j. Demonstrate how drainage from the proposed driveway for the new home would be prevented from going toward the existing driveways to the north. Res. 2010-145 File 2010022 Page 3 9. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Compliance with the city's tree preservation regulations. c. Removal of all hazardous trees from the property at the owner's expense. d. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
