HomeMy WebLinkAboutCity Council Resolution 2010-139CITY OF PLYMOUTH RESOLUTION No. 2010-139 A RESOLUTION DECLARING A FINDING OF "NO -NEED" FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED MARCH 24, 2010 FOR THE PROPOSED PLYMOUTH CREEK STREAMBANK RESTORATION PROJECT CITY PROJECT NO. 8128 WHEREAS, the Planning Commission has reviewed the Environmental Assessment Worksheet (EAW) for the Plymouth Creek Streambank Restoration Project at a publicly noticed meeting on April 21, 2010; and WHEREAS, pursuant to Minnesota Environmental Review Program riles, the City of Plymouth, acting as the responsible governmental unit, prepared and distributed an EAW for the Plymouth Creek Streambank Restoration Project on April 5, 2010; and WHEREAS, the 30 -day review period expired on May 5, 2010, and all comments and recommendations received from the reviewing agencies and other interested parties have been considered; and WHEREAS, it has been determined that the proposed project does not present a potential for environmental impacts of such significance that an Environmental Impact Statement would be required. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the Plymouth City Council makes a negative declaration on the need for an Environmental Impact Statement for the Plymouth Creek Streambank Restoration Project based on the Record of Decision and subject to the following conditions: a. Compliance with all statements in the attached Record of Decision. b. Wetland mitigation shall occur as required by the appropriate permitting agencies. c. Strict adherence to the City's Erosion Control Ordinance shall be met during constriction and until the site is re -vegetated. APPROVED THIS 25TH DAY OF MAY, 2010.
