HomeMy WebLinkAboutCity Council Resolution 2010-134CITY OF PLYMOUTH RESOLUTION No. 2010-134 A RESOLUTION APPROVING AN INTERIM USE PERMIT FOR PERL LANDSCAPING FOR PROPERTY LOCATED AT 3855 COUNTY ROAD 101 (2010027) WHEREAS, Perl Landscaping has requested approval of an interim use permit top allow stockpiling of fill for the site legally described as follows: The east 290 feet of the south 402 feet of the north 632 feet of the South Half of the Northwest Quarter of the Southeast Quarter of Section 18, Township 118 North, Range 22 West of the 5th Principal Meridian, Hennepin County. Also, the east 480 feet of the north 230 feet of the South Half of the Northwest Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County. Also, that part of the west 420 feet of the east 710 feet of the South Half of the Northwest Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, lying south of the north 230 feet thereof, and north of the following described line: Commencing at the southeast corner of the Southwest Quarter of said Southeast Quarter; thence north along the east line thereof 704 feet; thence deflecting left 55 degrees 50 minutes to the southerly extension of the east line of said west 420 feet; thence north along said southerly extension of said east line a distance of 553.2 feet to the point of beginning of the line to be described; thence deflecting left 88 degrees 06 minutes to the west line of said east 710 feet; and there ending. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Perl Landscaping for an interim use permit for filling operations at 3855 County Road 101, subject to the following conditions: 1. This interim use permit is approved to allow stockpiling of roughly 1,500 cubic yards of fill, in accordance with the plan received by the city on April 6, 2010, except as may be amended by this resolution. Res. 2010-134 File 2010027 Page 2 2. Prior to issuance a required grading permit, silt fencing shall be installed along the north and west edges of both berms. 3. The fill shall consist of earthen material and shall not consist of garbage, animal or vegetable refuse, poisons, contaminants, chemicals, decayed material, filth, sewage or similar septic or biologically dangerous material. 4. Compliance with section 2025 (Noise) of the city code. The hours for filling operations and any related grading shall be limited to between 7:00 AM and 7:00 PM Mondays through Fridays, and between 8:00 AM and 6:00 PM on Saturdays. 5. The applicant shall reshape the dirt piles into berms and complete all related grading and site restoration, including seeding to establish a vegetative ground cover, within six months from the date of approval of the interim use permit by the City Council. 6. Erosion control blankets shall be provided for berm slopes that are 3:1 or greater. 7. Erosion control blankets and silt fence shall be maintained until vegetative ground cover is established, as required by the city engineer. 8. Indicate proposed contour elevations and how they tie in with existing contours. 9. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. ADOPTED by the City Council on May 25, 2010.
