RESOLUTION NO. 2010-108
A RESOLUTION TO APPROVE ENCROACHMENT AGREEMENTS
FOR RETAINING WALL WITHIN LOT 1, BLOCK 1, FOUR POINTS OF PLYMOUTH AT
4290 WESTON LANE AND LOT 2, BLOCK 3, NORTHFORK AT 4300 WESTON LANE
WHEREAS, Pomroy Limited Partnership has requested the approval for an encroachment
agreement to allow for retaining wall within a public drainage and utility easement located at 4290
Weston Lane and 4300 Weston Lane; and
WHEREAS, the encroachment agreements only permit the encroachment of the proposed
retaining wall along with landscaping amenities within the public drainage and utility easement and
all related facilities must still meet all applicable City codes; and
WHEREAS, the properties are legally described as Lot 1, Block 1, Four Points of Plymouth
& Lot 2, Block 3, Northfork.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to
sign, on behalf of the City of Plymouth these encroachment agreements that will allow the retaining
wall to occupy a public drainage and utility easement.
