CORRECTIVE RESOLUTION NO. 2015-296
THE PURPOSE OF THIS INSTRUMENT IS TO CORRECT THE ADDRESS OF THE
SUBJECT PROPERTY IN THAT CERTAIN RESOLUTION NO. 2015-296 ADOPTED BY
THE CITY COUNCIL ON OCTOBER 13, 2015, AND RECORDED OCTOBER 30, 2015, AS
DOCUMENT NO. T05302785 IN THE OFFICE OF THE REGISTRAR OF TITLES OF
HENNEPIN COUNTY, MINNESOTA.

WHEREAS, Wayzata Public Schools has requested approval of a conditional use permit to
allow a daycare/preschool use and early childhood family education programs at 1455 County Road
101, legally described as follows:
Lot 1, Block 2, Schiebe’s Oakwood, Hennepin County, Minnesota.
AND
That part of vacated County Road No. 6 as dedicated in the recorded plat of Schiebe’s
Oakwood, described as follows: Beginning at the intersection of the North line of Lot 1,
Block 2 in said plat and the West line of the East 70 feet of the Southeast Quarter of Section
30, Township 118, Range 22; thence Westerly and Northerly along the Northerly and
Easterly lines of said Lot 1 to the intersection with a line drawn parallel with and 60 feet
South from the survey line as delineated on Hennepin County State Aid Highway No. 6,
Plat No. 5, according to Doc. No. 976842; thence Easterly along said parallel line to a point
distant 35 feet Westerly, measured along said parallel line from the intersection with said
West line of the East 70 feet; thence Southeasterly to a point of said West line distant 35
feet Southerly, measured along said West line from the intersection with said parallel line;
thence Southerly along said West line to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Wayzata
Public Schools for a conditional use permit, subject to the following conditions:
1.A conditional use permit is approved to allow a daycare/preschool use and early childhood family
education programs within a 28,436-square foot lease-space of the existing building located at 1455
County Road 101 and related site improvements, in accordance with the plans received by the city

on August 28, 2015, except as may be amended by this resolution, with the finding that all applicable
conditional use permit standards would be met.
2.Prior to commencement of any construction, a separate building permit is required.
Prior to building permit issuance or occupancy,
3. the applicant shall submit the required
information, and revise the plans as indicated below:
a.Provide a building code analysis for allowable area.
b.Provide turning radius evaluations as required by the Fire Inspector.
c.Indicate fire lane signage, in locations as approved by the Fire Inspector.
d.Provide a 20-foot wide minimum drive aisle and fire lane adjacent to the outdoor play area.
e.Revise the plans to indicate a six-foot high wood (or other equivalent approved material)
privacy fence around the outdoor play area.
f.Indicate protective bollards around the fencing for the outdoor play area.
g.Revise the plans to indicate a painted directional arrow and a “do not enter” sign at the south
end of the southbound one-way drive aisle along the west side of the building.
4.Standard Conditions:
a.Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign
permits if required.
b.Any subsequent phases or expansions are subject to required reviews and approvals per
ordinance provisions.
c.The conditional use permit shall expire one year after the date of approval, unless the property
owner or applicant has started the project, or unless the applicant, with the consent of the
property owner, has received prior approval from the city to extend the expiration date for up
to one additional year, as regulated under section 21015.07 of the zoning ordinance.
