AND FOSS SWIM SCHOOL FOR PROPERTY LOCATED AT 1413023 RD AVENUE NORTH (2010015) WHEREAS, Therapy Junction has requested approval of a conditional use permit for the site legally described as follows: That part of the Southeast Quarter of the Northwest Quarter of the Northwest Quarter of Section 27, Township 118 North, Range 22 West of the 5th Principal Meridian, lying West of the West line of United States Interstate Highway No. 494. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Therapy Junction Inc. for a conditional usepermit to allow a sports and fitness club in the existing industrial building located at 14130 2-1 Avenue North, subject to the following conditions: 1. A conditional use permit is approved to allow a 4,800 square foot fitness club, including Therapy Junction and Foss Swim School, in accordance with the application and plans received by the city on February 22, 2010, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. 3. Prior to construction of tenant improvements to or within the building, the applicant must obtain separate approval of a building permit. 4. Prior to issuance of a building permit, the applicant shall submit material safety data sheets and quantities of all chemicals used and stored in the building and a description of the processes of transferring the chemicals to the pool. Res. 2010-074 File 2010015 Page 2 5. Standard Conditions: a. Any signage shall comply with the city's sign regulations. b. All waste and waste containers shall be stored within approved designated areas. c. All parking shall be off-street in designated areas which comply with the zoning ordinance. d. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. e. This approval shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the zoning ordinance.
