HomeMy WebLinkAboutCity Council Resolution 2010-072CITY OF PLYMOUTH RESOLUTION NO. 2010-072 A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "TARYN HILLS 9T" ADDITION" FOR PROPERTY LOCATED SOUTHEAST OF COUNTY ROAD 47 AND VICKSBURG LANE (2010012-F) WHEREAS, U.S. Home Corporation has requested approval of a final plat for 49 multi -family lots and 12 common space outlots on 6.48 acres of land located southeast of County Road 47 and Vicksburg Lane in the "Taryn Hills" plat; and WHEREAS, the property is presently legally described as follows: Outlot I, Outlot J, and Outlot K, Taryn Hills 8t1' Addition; Outlot D, Taryn Hills 5t1' Addition. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by U.S. Home Corporation for a final plat for Taryn Hills 9t1' Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for Taryn Hills 9t1' Addition is approved in accordance with the plans received by the city on February 8, 2010, except as may be amended by this resolution. Prior to recording the final plat, the applicant shall execute a development contract for the public and private improvements, and shall submit the required financial guarantees. 3. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Zoning ordinance/ city code requirements: (1) The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time the final plat is recorded. (2) The homeowner's association documents shall include language ensuring HOA maintenance of the association common spaces including sidewalks, landscaped areas, and similar features, and prohibiting storage in the parking spaces of the multi -family areas—including storage of recreational vehicles. b. Assessment/ easement/ agreement/ permit requirements: (1) Drainage and utility easements must be provided over Outlot H and Outlot J. (2) Necessary permits and approvals from other agencies: MPCA – verify if previous approval is valid, Elm Creek Watershed – verify if previous approval is valid, and NPDES – verify if previous approval is valid. c. Grading and erosion control plans: (1) The lowest floor elevation must be a minimum of two feet above adjacent water bodies. In addition, there must a minimum of 18 inches of freeboard between the lowest building opening where storm water may enter (doors or windows) and the designated emergency overland overflow. d. Street and utility plans: (1) Add a note to the plans stating "The contractor shall contact the Plymouth Sewer and Water Department at (763) 509-5950 a minimum of 48 hours prior to any public sewer/watermain connection." (2) The site utilities have not been reviewed by the Plymouth Engineering Department for compliance with the State Plumbing Code. (3) Show silt fence and indicate inlet protection for new catch basins. (4) The 2010 City of Plymouth Engineering Guidelines and Standard Specifications shall apply. Resolution 2010-072 File 2010012-F Page 3 4. Prior to issuance of building permits permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 5. Prior to issuing certificates of occupancy, the developer shall: a. Install unit address/ directional signage on the private drives where they intersect with public roadways. b. Install approved "no parking fire lane" signs in approved locations on both sides of all private drive entrances from streets, and on the south end of the private drive on Outlot I. 6. The developer shall notify potential buyers about future roadway expansion and improvement projects for County Road 47 and Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway projects. 7. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Development standards shall be as required by the RMF -3 district. No variances are granted or implied. c. Any signage shall require separate permits and shall comply with the city's signage regulations. d. A reproducible 8 '/z x I I inch "as -built" fire protection plan shall be submitted prior to the release of financial guarantees. e. A reproducible mylar print and electronic file format (AutoCad DWG file format) of sanitary sewer, water service, storm sewer and pond as-builts for the site shall be submitted prior to the release of financial guarantees. f. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 512 of city code.
