HomeMy WebLinkAboutCity Council Resolution 2010-071CITY OF PLYMOUTH RESOLUTION NO. 2010-071 A RESOLUTION APPROVING A SITE PLAN, CONDITIONAL USE PERMIT, AND VARIANCE FOR GRIFFEN PROPERTY HOLDINGS, LLC FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF 61 ST AVENUE AND VICKSBURG LANE (2010006) WHEREAS, Griffen Property Holdings, LLC has requested approval of a site plan, conditional use permit, and variance for "Foundation Hill Montessori and Childcare" at the southeast corner of 61" Avenue and Vicksburg Lane, for property to be legally described as follows: Lot 1, Block 1, Taryn Hills Commercial 2"a Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Griffen Property Holdings, LLC for a site plan, conditional use permit, and variance to allow a childcare center at the southeast corner of 61" Avenue and Vicksburg Lane, subject to the following conditions: 1. A site plan, conditional use permit, and variance are approved to allow a 10,176 square foot childcare center, in accordance with the plans received by the city on February 19, 2010, except as may be amended by this resolution. 2. Approval of the site plan is contingent upon City Council approval of final platting to a lot/block status for the daycare site. 3. The requested conditional use permit to allow the daycare and variance to allow a five-foot parking setback from the south lot line are approved with the finding that all applicable standards are met. Resolution 2010-071 File 2010006 Page 2 4. Prior to issuance of building permits, the following items shall be completed: a. The final plat shall be recorded with Hennepin County. b. The applicant shall submit the required financial guarantee and shall execute a site improvement performance agreement as required by the city. c. The park dedication fee in lieu of land dedication shall be paid, in accordance with the dedication ordinance in effect at the time of building permit issuance. d. The applicant shall obtain the necessary permits and approvals as follows: Elm Creek Watershed Management Commission, Minnesota Department of Health for watermain extension, and NPDES. 5. Prior to issuance of building permits, the applicant shall revise the plans, as follows: a. Indicate a pedestrian ramp near the 61" Avenue/Vicksburg Lane intersection for the new sidewalk. b. Indicate installation of a sidewalk segment that would connect the existing sidewalk along the north -south internal access road to the new sidewalk that would be installed along the south side of the building. c. Indicate that all watermain shall be C900 PVC. d. The contract documents shall include the standard detail specifications per the City of Plymouth Engineering Guidelines. 6. The city trail along Vicksburg Lane adjacent to the site does not need to be installed as part of this daycare building project. The city trail would be installed as part of the fiiture reconstruction project for Vicksburg Lane. 7. The freestanding sign shall not be lighted between 10:00 p.m. and 6:00 a.m. 8. Standard Conditions: a. Mechanical equipment shall be screened in compliance with the zoning ordinance. b. Trash and recycling storage shall be in compliance with the zoning ordinance. c. Signage shall comply with the signage regulations and shall receive prior approval of the appropriate sign permit. d. Lighting shall comply with the lighting regulations, including the requirement for house -side shielding, as applicable. e. The applicant shall submit a reproducible 8'/z x 11 inch "as built" fire protection plan prior to the release of any financial guarantees. f. The applicant shall submit reproducible mylar prints of sanitary sewer, water service, and storm sewer as-builts for the site prior to the release of any financial guarantees. g. An approved fire department lock box is required at the main entry door on the south side of the building. Resolution 2010-071 File 2010006 Page 3 h. Fire lane signage shall be placed at the west end of the drive aisle, as approved by the fire inspector. i. The site plan, conditional use permit, and variance shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Sections 21045.09, 21015.07, and 21030.06 respectively, of the zoning ordinance.
