HomeMy WebLinkAboutCity Council Resolution 2010-034CITY OF PLYMOUTH RESOLUTION No. 2010-034 A RESOLUTION AUTHORIZING THE VACATION OF A PORTION OF A PLATTED DRAINAGE EASEMENT WITHIN LOT 5, BLOCK 5, SUNNY ACRES SECOND ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for January 26, 2010 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of January 26, 2010; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the City Council did hold a public hearing on January 26, 2010 to inform any and all interested parties relevant to the vacation of that portion of the platted drainage easement within Lot 5, Block 5, Sunny Acres Second Addition; and WHEREAS, it was determined by the City Council that said easement is not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of said drainage easement within Lot 5, Block 5, Sunny Acres Second Addition be vacated: That part of the platted drainage easement within said Lot 5, Block 5 lying northerly and westerly of the following described line: Commencing at the northwest corner of Lot 5, Block 5, Sunny Acres Second Addition; thence southerly along the west line of said Lot 5, a distance of 93.0 feet; thence easterly perpendicular to said west line of Lot 5, a distance of 65.0 feet to the point of beginning of said easement to be vacated: Thence continuing easterly 20.0 feet; thence northerly deflecting to the left 90 degrees 00 minutes 00 seconds to the northerly line of said platted drainage easement and there terminating. RESOLUTION No. 2010-034 PAGE 2 OF 2 FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
