HomeMy WebLinkAboutCity Council Resolution 2000-593CITY OF PLYMOUTH RESOLUTION 2000-593 APPROVING SITE PLAN AMENDMENT FOR AN 11,120 -SQUARE FOOT ADDITION AND AN INTERIM USE PERMIT TO REDUCE THE NUMBER OF REQUIRED PARKING STALLS FOR THE AT&T BUILDING AT 13320 15TH AVENUE NORTH (20170) WHEREAS, Pope Associates Inc. has requested approval of a site plan amendment to allow construction of an 11,120 -square foot building addition and an interim use permit to reduce the number of required parking stalls on property legally described as follows: Lot 2, Block 1, Plymouth Orchards 2nd Addition, according to the recorded plat thereof, Hennepin County, Minnesota. Together with part of vacated Old County Road No. 6, accruing thereto by reason of vacation thereof. And That part of Lot 3, Block 1, Plymouth Orchards 2nd Addition, according to the recorded plat thereof, Hennepin County, Minnesota, described as commencing at the northwest corner of said Lot 3, thence on an assumed bearing of South 00 degrees, 36 minutes 37 seconds East along the west line of Lot 3 a distance of 287.19 feet to the point of beginning; thence continuing South 00 degrees 36 minutes 37 seconds East a distance of 48.50 feet; thence South 89 degrees 23 minutes 23 seconds West a distance of 75.00 feet to a point on a west line of Lot 3; thence North 00 degrees 36 minutes 37 seconds West along said west line of Lot 3 a distance of 48.50 feet to a point on a north line of Lot 3; thence North 89 degrees 23 minutes 23 seconds East along said north line a distance of 75.00 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; Resolution 2000-593 (20170) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the site plan amendment for a building addition and an interim use permit to reduce the number of required parking stalls on property located at 13320 15th Avenue North, subject to the following conditions: 1. A site plan amendment is approved to allow construction of an approximately 11,120 -square foot addition, in accordance with the plans and application received by the City on October 27, 2000, except as amended by this resolution. 2. The interim use permit is to permit a reduction in the number of required parking stalls from 23 to 10, according to the plans and application received by the City on October 27, 2000, except as amended by this resolution. 3. The interim use permit shall terminate if any of the following events occur: a. The use of the building changes to a use that increases the need for parking spaces. b. City staff documents a parking problem associated with inadequate parking. c. The floor area of the building is increased in size. 4. Prior to issuance of building permits, the site plan must be revised to remove the proposed 10 -foot chainlink fence. 5. Prior to issuance of building permits, the plans must be revised to identify the current property boundaries. The property that was acquired from U.S. West in 1999 must be shown as part of the subject property. 6. All exterior lighting must comply with Section 21105.06 of the Zoning Ordinance. 7. All waste and waste containers shall be stored within the enclosure structure, and no outside storage is permitted. 8. Building permits are required prior to beginning construction. 9. The applicant must comply with the conditions in the City Engineer's Memorandum. 10. Standard Conditions: a. Submission of the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes, post - indicator valves, fire department connections, fire lanes, and fire lane signage. d. Submission of fire flow calculations prior to issuance of building permits. Resolution 2000-593 (20170) Page 3 e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. g. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21020.02 of the Zoning Ordinance.
