RESOLUTION NO. 2010-027
A RESOLUTION APPROVING VARIANCES FOR STONE SOURCE FOR PROPERTY LOCATED AT
15831 STATE HIGHWAY 55 (2009058)
WHEREAS, an application has been filed by Stone Source for variances to allow 1) two
freestanding signs and 2) a maximum of 765 square feet of wall signage for property legally
described as follows:
Lot 3, Block 1, Playhouse Industrial Park, except that part of the west 484.96 feet of said
Lot 3 which lies southerly of a line running from a point in the east line of the west
484.96 feet of said Lot 3 therein distant 160.00 feet north of the south line of said Lot 3 to
a point in the west line of said Lot 3 therein distant 210.00 feet north of the southwest
corner of said Lot 3;
WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Stone
Source for variances to the sign regulations for property located at 15831 State Highway 55,
subject to the following conditions:
1. This resolution approves 1) a variance to allow two freestanding signs, one 100 -square foot
sign on Highway 55 and one 30 -square foot sign on 32nd Avenue; and 2) a maximum 765
square feet of wall signage on the north side of the building, in accordance with the
application and materials received by the City on October 1 and 26, 2009, November 17,
2009, December 23, 2009 and January 7, 2010 except as amended by this resolution.
2. The sign variances are approved with the finding that the applicable variance standards are
met. Specifically:
a) The situation presents a particular hardship unique to this property because there is no
visibility to the building from 32nd Avenue and the building was designed assuming
partial access to Highway 55 and full access from Vicksburg Lane.
b) The lack of visibility from 32nd Avenue is related to the shape of the property and is not
generally applicable to other properties guided C-2.
c) The hardship is caused by the Zoning Ordinance. The applicant is requesting the
variance to offset the lack of visibility and design of the stricture.
d) The sign variances would not have an effect on the public welfare or be injurious to other
land or improvements in the area. The only proposed change from the existing condition
would be too allow additional wall signage on the north side of the property.

e) The requested variances are reasonable based upon the circumstances related to this site
and appear to be the minimum action necessary to address the hardship.
The applicant shall remove the two poles installed near the freestanding sign on 32nd Avenue
and the existing freestanding sign by June 1, 2010.
4. The applicant shall add address signage to the freestanding sign on 32nd Avenue. The letters
shall be a minimum of six inches in height and be located a minimum of three feet from
grade.
5. No electronic signage shall be permitted on the freestanding sign on 32nd Avenue.
6. The property shall be limited to wall signage on three sides of the building and the three sides
together shall not exceed 10 percent of the total wall area on the three affected sides.
7. Permits are required for all permanent wall signage, except those signs specifically listed in
Section 21155.
8. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
9. This variance approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless the
landowner or applicant has received prior approval from the City to extend the expiration
date for up to one additional year, as regulated under Section 21030.06 of the Zoning
Ordinance.
