HomeMy WebLinkAboutCity Council Resolution 2000-534CITY OF PLYMOUTH RESOLUTION 2000-534 APPROVING CONDITIONAL USE PERMIT AMENDMENT TO ALLOW A 2,000 SQUARE FOOT EXPANSION OF A DANCE STUDIO FOR PROPERTY LOCATED AT 1864 BERKSHIRE LANE NORTH (2015 1) WHEREAS, the Virginia Luoma Dance Studio has requested approval of a conditional use permit amendment to allow a 2,000 square foot expansion of a dance studio on property legally described as follows: That part of Lot 1 lying west of the easterly 368 feet thereof, also the northerly 530 feet of the east 368 feet of Lot 1; also that part of Lot 3 lying north of the southerly 300 feet thereof and lying west of a line parallel with and 368 feet west of the southerly extension of said Lot 1, Block 4, also that part of Lot 2 lying north of a line described as beginning at the intersection of a point on the west line of said Lot 2 with a line parallel with and 281.50 feet north measured at right angles from the south line of said Lot 2, thence east parallel with said south line to intersection with a line perpendicular to the south line of Lot 2 from a point therein distant 237.50 feet west of the southeast corner of said Lot 2, thence north at right angles distant 20 feet, thence east at right angles 230 feet, thence south at right angles to the intersection of the east line of said Lot 2 and there terminating, all in Block 4, Minneapolis Industrial Park 2"d, Section 27, township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the conditional use permit amendment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the conditional use permit amendment for a 2,000 square foot expansion of a dance studio on property located at 1864 Berkshire Lane North, subject to the following standard conditions: Resolution 2000-534 (99011) Page 2 of 2 1. This approval is for a conditional use permit amendment for a 2,000 square foot expansion of a dance studio in accordance with the plans received by the City on September 26, 2000, except as modified by this resolution. 2. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 3. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 4. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
