RESOLUTION 2000-533
APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR MARK AND JODY
DEZIEL FOR PROPERTY LOCATED AT 19045 HAMEL ROAD (20148)
WHEREAS, Mark and Jody Deziel have requested a comprehensive plan amendment to add
property to the Metropolitan Urban Service Area (MUSA) and reclassify it from LA -R (Living
Area -Rural) to LA -1 (Living Area -1), said property located at 19045 Hamel Road, legally
described as follows:
Parcel 1: The west 93 feet of that part of the northwest quarter of the southwest quarter, Section
7, Township 118, Range 22, which lies south of the Rockford Road, Hennepin County,
Minnesota.
Parcel 2: Commencing at a point 93.0 feet east of the southwest corner of the northwest quarter
of the southwest quarter, Section 7, Township 118, Range 22 for a place of beginning; thence
north and parallel with the west line of said northwest quarter of the southwest quarter, a distance
of 100.7 feet, more or less, to the southerly line of County Road No. 9; thence southeasterly on
the southerly line of said County Road 9 distant 13.5 feet; thence southwesterly 98.5 feet to a
point on the south line of said northwest quarter of the southwest quarter distant 7.15 feet east of
the point of beginning; thence west 7.15 feet to the place of beginning.
Also, that part of the southwest quarter of the southwest quarter of Section 7, Township 118
north, Range 22 west of the 5th principal meridian, Hennepin County, Minnesota described as
follows: Commencing at the northwest corner of said southwest quarter of the southwest quarter;
thence east on the north line of said southwest quarter of the southwest quarter a distance of
100.15 feet; thence southwesterly 33.5 feet to a point 97.0 feet east and 33 feet south of the
northwest corner of said southwest quarter of the southwest quarter; thence west and parallel
with the north line of said southwest quarter of the southwest quarter a distance of 97 feet to the
west line of said southwest quarter of the southwest quarter; thence north 33 feet to the point of
beginning.

WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for a
comprehensive plan amendment for the property located at 19045 Hamel Road, based on the
following findings and subject to the following conditions:
Findings:
1. Adding the property to the MUSA and reguiding it to LA -1 would result in the elimination of
an existing outdated, on-site sanitary sewer disposal system, which in turn would eliminate
adverse environmental effects and help to prevent the potential for ground water
contamination.
Conditions:
1. Approval of this comprehensive plan amendment is contingent upon execution of an
agreement between the Cities of Plymouth and Medina for Medina to provide its municipal
sanitary sewer service to 19045 Hamel Road.
2. Approval of this comprehensive plan amendment is contingent upon, and subject to, the
required review and response by the Metropolitan Council.
FURTHER, to incorporate these changes, the City will make modifications to the following
figures in the City's Comprehensive Plan:
1) Figure 4-1 (Page 4-3) entitled "Northwest Plymouth"
2) Figure 4-2 (Page 4-4 entitled "Development Staging Plan"
3) Figure 4-3 (Page 4-22) entitled "2020 Land Use Guide Plan"
4) Figure 10-4 (Page 10-22) entitled "Development Staging Plan"
