RESOLUTION NO. 2000-503
AMENDING APPROVAL OF SITE PLAN AND CONDITIONAL USE
PERMIT FOR PEONY PROMENADE
RESOLUTION NO. 2000-421
WHEREAS, on August 22, 2000 the City Council adopted Resolution 2000-421 approving
the Site Plan and Conditional Use Permit for Peony Promenade; and
WHEREAS, as part of that approval a public sanitary sewer and public watermain was
required to be extended from Peony Lane westerly across the property; and
WHEREAS, other properties will incur benefit from this sanitary sewer extension and the
City should incur a portion of the cost for the part of the watermain within the Peony Lane
right-of-way; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That Resolution No. 2000-421 is revised as
follows:
Condition No. 15A of the resolution is revised to the following:
Compliance with the City Engineer's memorandum, dated July 20, 2000 — except Condition
No. 8a will be revised to the following:
Condition No. 8a — the developer shall be responsible to extend the public sanitary sewer
from Peony Lane for approximately 204 feet to Manhole No. 5 as indicated on the plans. At
Manhole No. 5 a stub for future extension to the west shall be provided and a drop manhole
connection for a future extension to the north. In addition to constructing this portion of
public sewer in accordance with City standards and dedicating the sewer to the public the
developer shall provide the necessary easements over the portion of the sewer to be
constructed and future extensions of the sewer within the site. This will fulfill the
developers obligation with regard to constructing public sanitary sewer to serve additional
properties westerly of this site in accordance with the City's Comprehensive Sanitary Sewer
Plan.
The developer shall construct the public trunk watermain as indicated on the plans from the
existing watermain on Peony Lane to the westerly boundary of the property. The City will
reimburse the developer the cost to construct that portion of watermain which is within the
Peony Lane right-of-way. The estimated cost is $15,000 and the reimbursement will be
based on actual cost incurred by the developer.
