HomeMy WebLinkAboutCity Council Resolution 2000-475CITY OF PLYMOUTH RESOLUTION 2000-475 DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED JULY 31, 2000 FOR THE PROJECT PROPOSED BY ROTTLUND HOMES, INC. FOR THE RESERVE, A 987 -UNIT RESIDENTIAL PLANNED UNIT DEVELOPMENT (20077) WHEREAS, the City Council has reviewed an Environmental Assessment Worksheet (EAW) for a 987 -unit residential planned unit development (PUD) on September 26, 2000; and, WHEREAS, pursuant to the Minnesota Environmental Review Program rule 4410.4300, Subpart 36, the City of Plymouth, as the responsible government unit submitted an Environmental Assessment Worksheet (EAW) for the proposed project on August 7, 2000; and, WHEREAS, the 30 -day review period expired on September 6, 2000, and all comments and recommendations received from reviewing agencies and other interested parties have been considered; and, WHEREAS, it has been determined that the proposed project does not present a potential for environmental impacts of such significance that an Environmental Impact Statement would be required; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does make a Negative Declaration on the need for an Environmental Impact Statement (EIS) for the proposed project known as The Reserve for Rottlund Homes, Inc., based on the Record of Decision and subject to the following conditions: Resolution 2000-475 Page 2 1. Compliance with all statements in the attached Record of Decision. 2. Wetland mitigation shall occur as required by the appropriate permitting agencies. Strict adherence to the City's Erosion Control Ordinance shall be met during construction and until the site is re -vegetated. 4. The proposed development shall include construction of on-site basins for storm water treatment that meet the National Urban Runoff Program (N URP) water quality guidelines, as well as the MPCA's Best Management Practices Manual and City of Plymouth's water quality requirements. A two -foot minimum vertical separation shall be required between the lowest floor elevation of any building adjacent to wetlands and ponding areas and the 100 -year flood elevation. 6. The development of the site shall comply with the City's shoreland and floodplain overlay zoning district requirements. 7. The development of the site shall comply with the City's tree preservation and landscaping requirements. Adopted by the City Council on September 26, 2000. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
