HomeMy WebLinkAboutCity Council Resolution 2000-421CITY OF PLYMOUTH RESOLUTION 2000-421 APPROVING SITE PLAN AND CONDITIONAL USE PERMITS FOR RELIANCE DEVELOPMENT COMPANY, LLC FOR PEONY PROMENADE, A RETAIL DEVELOPMENT ON PROPERTY LOCATED NORTH OF HIGHWAY 55 AND WEST OF PEONY LANE (20004) WHEREAS, Reliance Development Company, Inc. has requested approval of a site plan and six conditional use permits to allow a retail development on property legally described as follows: Tract E, Registered Land Survey No. 187, Files of Registrar of Titles, County of Hennepin, except the southwesterly 112.5 feet thereof. Tract B, Registered Land Survey No. 1091, Files of Registrar of Titles, County of Hennepin, except that part thereof lying north of a line drawn from the most southerly corner of Tract A, said Registered Land Survey, to a point on the east line of said Tract B, distant 219.41 feet south from the northeast corner of said Tract A. That part of the east 33 feet of the east half of the northwest quarter of the northeast quarter of Section 18, Township 118, Range 22, lying southerly of the easterly extension of a line drawn from the most southerly corner of Tract A, Registered land Survey No. 1091, Files of Registrar of Titles, County of Hennepin, to a point on the east line of Tract B, said Registered Land Survey, distant 219.41 feet south from the northeast corner of said Tract A. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Resolution 2000-421 (20004) Page 2 of 4 site plan and conditional use permits for a retail development on property located north of Highway 55 and west of Peony Lane, subject to the following conditions: 1. A site plan and six conditional use permits are approved to allow a retail development on the subject site, in accordance with the plans received by the City on June 23, 2000, except as amended by this resolution. 2. Approval of the site plan and conditional use permit is contingent upon prior City Council approval of a wetland mitigation plan for the project. 3. Prior to the issuance of building permits, the applicant shall submit a revised lighting plan to address the lighting intensity under the gas pump canopy, demonstrating compliance with the lighting ordinance. 4. The operation shall be responsible for litter control within 300 feet of the premises and litter control is to occur on a daily basis. Trash receptacles must be provided at convenient locations on the site to facilitate litter control. 5. All signage shall comply with the sign regulations of the Zoning Ordinance. The roughly 100 -square foot identification sign on the retaining wall near the bank in the southeast portion of the site is not allowed unless a separate variance is granted in the future. 6. Prior to the issuance of the building permit for each building, the applicant shall submit final building elevations for staff review and approval. The building materials and design must relate the buildings to one another to create a unified development. 7. The proposed fence for the daycare center shall not exceed five feet in height. 8. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 9. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 10. The developer shall not use the trail along Peony Lane for access or storage. Any damage done to the trail during construction shall be repaired at the developer's expense. If the development is platted in the future, cash park dedication fees will be due at the rate in effect at the time of platting. 11. If the development is to be constructed in phases, the developer shall submit a phasing plan for installation of driveways, fire lanes, utilities, landscaping, etc., for prior staff approval. Because the number of parking spaces proposed exceeds the City's requirement by 13 stalls, construction of up to 13 parking stalls may be converted to landscaped areas. 13. If the site is proposed for subdivision in the future, the applicable wetland buffer setbacks required at that time must be provided. 14. The hours of operation for the gas/convenience store are extended from 5:30 a.m. to 12:30 a.m. 15. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Compliance with the Ordinance regarding the location of fire hydrants, fire department connections and fire lane signage. D. Submittal and approval of fire flow calculations prior to issuance of building permits. E. The fire lane construction details, temporary access and water supply policy, fire hydrant detail, and Plymouth Fire Department notes must be imprinted on the plans at the time of building permit review. F. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Compliance with regulations regarding handicapped parking spaces and access. H. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. I. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
