HomeMy WebLinkAboutCity Council Resolution 2000-401CITY OF PLYMOUTH RESOLUTION 2000-401 APPROVING A SITE PLAN AMENDMENT AND VARIANCES FOR THE CITY OF PLYMOUTH TO CONSTURCT ADDITIONAL BALL FIELDS, SOCCER FIELDS AND ASSOCIATED FACILITIES AT GREENWOOD ELEMENTARY SCHOOL LOCATED AT 18005 MEDINA ROAD (20104) WHEREAS, the City of Plymouth has requested approval of a site plan amendment and variances for additional ball fields, soccer fields and associated facilities on property legally described as follows: That part of the south '/z of the northwest of the southeast 1/4, and of the southwest'/4 of the southeast 1/4, lying southwesterly of the following described line: Commencing at the southeast corner of said southwest'/4 of the southeast 1/4; thence north along the east line thereof 704 feet to the point of intersection of said east line with the centerline of Medina Road, said point being the point of beginning of the line being described; thence deflecting left 55 degrees 50 minutes along said centerline a distance of 1400 feet; thence on said centerline along a tangential curve to the left having a radius of 700 feet to its intersection with the west line of said south half of the northwest'/4 of the southeast 1/4, and there ending; except the northeasterly 33 feet of said property; also except that part of said southwest'/4 of the southeast'/4 described as follows: Commencing at the southeast corner of said southwest 1/4 of the southeast 1/4; thence north along the east line thereof 290.67 feet to the point of beginning of the exception being described; thence continuing north 413.33 feet to the point of intersection of said east line with the centerline of Medina Road; thence deflecting left 55 degrees 50 minutes along said centerline a distance of 577.6 feet; thence deflecting left 90 degrees a distance of 342 feet; thence deflecting left to the point of beginning; also except that part of said southwest'/4 of the southeast 1/4 described as follows: Commencing at the southeast corner of said southwest'/4 of the southeast 1/4; thence north along the east line thereof 704 feet to the point of intersection of said east line with the centerline of Medina Road; thence deflecting left 55 degrees 50 minutes along said centerline a distance of 637.6 feet to the point of beginning of the exceptions being described; thence continuing on last -said course along said centerline 330 feet; thence deflecting left 90 degrees a distance of 433 feet; thence deflecting left 90 degrees a distance of 330 feet; thence Resolution 2000-401 (20104) Page 2 deflecting left to the point of beginning, all in Section 18, Township 118 North, Range 22 West of the 5th Principal Meridian. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the City of Plymouth for a site plan amendment and variances for property located at 18005 Medina Road, subject to the following conditions: A site plan amendment and variances for ball fields, soccer fields and associated facilities is hereby approved, in accordance with the application and plans received by the City on July 11, 2000, except as amended by this resolution and contingent on the rezoning of a portion of the affected site. 2. Variances are approved for an 18 -foot setback from Medina Road and six-foot high fences around the ball fields adjacent to Medina Road, based on the finding that applicable variance standards have been met. 3. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 4. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 5. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning Ordinance. 6. Standard Conditions: a. The applicant must comply with the City Engineer's Memorandum. b. The applicant shall remove all hazardous trees from the property at the owner's expense. c. The applicant shall comply with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. ADOPTED by the City Council this 22nd day of August 2000.
