HomeMy WebLinkAboutCity Council Resolution 2000-392CITY OF PLYMOUTH RESOLUTION 2000-392 APPROVING A SITE PLAN AND VARIANCES FOR CARLSON REAL ESTATE COMPANY FOR AN OFFICE BUILDING LOCATED ON PROPERTY AT THE NORTHWEST QUADRANT OF 35TH AVENUE AND PLYMOUTH BOULEVARD (20091) WHEREAS, Carlson Real Estate Company has requested approval of a site plan and variances to allow development of an office building on property legally described as follows: Lot 3, Block 1, Plymouth Hills 6th Addition WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Carlson Real Estate Company for a site plan and variances for property located at the northwest quadrant of 35th Avenue and Plymouth Boulevard, subject to the following conditions: 1. A site plan and variances for an office building is hereby approved, in accordance with the application and plans received by the City on June 9, 2000 and revisions received on July 11, 2000, except as amended by this resolution. 2. Variances are approved for parking at the point of street intersections, parking set back 15 feet from 35th and 36th Avenues and parking set back five feet from a roughly 20 -foot section of the north side of the building, based on the finding that applicable variance standards have been met. 3. A variance is approved for two directional signs ten square feet in area, based on the finding that the applicable variance standards have been met. 4. Prior to the issuance of building permits, the applicant shall revise the site plan to provide a ten -foot setback from property lines for the monument sign. Resolution 2000-392 (20091) Page 2 5. Except for the noted variance, all signage shall comply with the sign regulations identified in Section 21155 of the Zoning Ordinance. 6. The applicant shall pay for and construct bump outs to create a parking bay along Plymouth Boulevard, contingent on the City Council implementing a master plan for Plymouth Boulevard from 34th Avenue across from City Hall to 37th Avenue. 7. Prior to the issuance of building permits, the applicant shall provide cut sheets for each of the proposed lighting fixtures to verify that the fixtures provide the shielding required by the Zoning Ordinance. 8. The applicant will provide two benches in the plaza area that meet City specifications. 9. The applicant must obtain the appropriate permits from the Building Division prior to commencing any work on the building. 10. Prior to the issuance of a certificate of occupancy, the applicant shall obtain cross access agreements for the shared site entrances. 11. Prior to the issuance of a certificate of occupancy, the applicant shall enter into an agreement with the City to allow LifeTime Fitness and Ice Arena patrons to use the on-site parking spaces adjacent to 36th Avenue during the evening and weekend hours. Such an agreement would reflect any potential need for evening and weekend parking on the part of Carlson tenants. 12. Prior to the issuance of building permits, the applicant shall revise the plans to show all drive aisles as fire lanes. 13. Prior to the issuance of building permits, the applicant shall submit the required fire flow calculations. 14. The applicant shall comply with the conditions outlined in the City Engineer's memorandum. 15. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 16. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 17. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning Ordinance. Resolution 2000-392 (20091) Page 3 18. Standard Conditions: a. The applicant must comply with the City Engineer's Memorandum. b. The applicant shall submit the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. c. The applicant shall remove all hazardous trees from the property at the owner's expense. d. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. e. Prior to issuance of building permits, the applicant shall submit fire flow calculations. f. The applicant shall submit an 8 1/2 x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement bonds per City Policy.
