HomeMy WebLinkAboutCity Council Resolution 2000-391CITY OF PLYMOUTH RESOLUTION 2000-391 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR LIBERTY PROPERTY LIMITED PARTNERSHIP FOR PROPERTY LOCATED EAST OF NATHAN LANE AND NORTH OF 45TH AVENUE (20059) WHEREAS, Liberty Property Limited Partnership has requested approval of a site plan and conditional use permit for property legally described as follows; Lot 1, Block 1, Drakeland Business and Technical Center, except that part of said Lot 1 lying Northerly, Northeasterly and Northwesterly of the following described line and its Westerly extension: Commencing at the most Easterly Southeast corner of said Lot 1; thence on an assumed bearing of North 00 degrees 59 minutes 09 seconds East, along the East line of said Lot 1, a distance of 129.00 feet to the point of beginning of said line; thence North 68 degrees 34 minutes 54 seconds West 405.40 feet; thence North 45 degrees 43 minutes 18 seconds West 786.63 feet; thence South 69 degrees 17 minutes 27 seconds West 63.62 feet to the intersection with the West line of said Lot 1 and said line there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Liberty Property Limited Partnership for a site plan and conditional use permit, subject to the following conditions: 1. A site plan is approved for an approximately 84,600 -square foot office/showroom building, according to the plans and application received by the City on April 21, 2000 and revisions received on July 7, 2000, except as amended by this resolution. A conditional use permit is approved to allow up to 40 percent of the gross building floor area for manufacturing, compounding, assembly, packaging, treatment or warehousing of merchandise or commodities as accessory uses in the B -C zoning district, subject to the following conditions: a. No more than 40 percent of each tenant space shall be used for manufacturing, compounding, assembly, packaging, treatment or warehousing of merchandise or commodities as accessory uses. b. No outdoor storage is permitted. c. The use must be accessory to permitted uses in the B -C zoning district. 3. No variances are granted or implied. 4. Prior to issuance of a grading permit, a certificate of exemption for the proposed deminimis wetland fill must be submitted for review and approval by the City Council. 5. Prior to issuance of building permits, the plans shall be revised to identify the location of wetland buffer monuments. Wetland buffer monuments shall be placed in accordance with Section 21670 of the Zoning Ordinance. 6. Prior to issuance of building permits, the applicant shall submit a revised lighting plan in conformance with the Zoning Ordinance standards. 7. Signage for this site shall be in compliance with the Sign Ordinance in effect at the time of sign permit application. The current Sign Ordinance allows wall signage on two building elevations, not the four elevations as proposed by the applicant. 8. Prior to issuance of building permits, the applicant shall either revise the plans to note that trash and recycling containers will be located inside building or revise the plans to include exterior trash enclosures in compliance with Section 21120.08 of the Zoning Ordinance. 9. Prior to issuance of building permits, the applicant shall revise the plans to comply with the required 10 -foot minimum setback between the building and parking/drive aisles. 10. Prior to issuance of building permits, the applicant shall revise the plans to identify drive aisle and parking space dimensions in compliance with Section 21135 of the Zoning Ordinance. 11. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage. d. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. e. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance.
