HomeMy WebLinkAboutCity Council Resolution 2000-379CITY OF PLYMOUTH RESOLUTION 2000-379 APPROVING LOT DIVISION/LOT CONSOLIDATION FOR TONY EIDEN COMPANY FOR LOTS 1 AND 2, BLOCK 1, WALNUT GROVE POND (20110). WHEREAS, an application has been filed by Tony Eiden Company which requests approval of a lot division and lot consolidation to divide and consolidate two parcels of land located in Walnut Grove Pond, as legally described on Attachment One, attached hereto and hereby made a part hereof, and WHEREAS, the existing lot arrangement approved by the City in 1998 is as legally described on Attachment Two, attached hereto and hereby made a part hereof, and WHEREAS, the proposed lot arrangement for which the lot division and lot consolidation is sought is as legally described on Attachment Three, attached hereto and hereby made a part hereof, and WHEREAS, the City Council has fully considered the request for the lot division/lot consolidation. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the lot division/lot consolidation for Tony Eiden Company subject to the following conditions: 1. This Resolution approves a lot division/lot consolidation for Lots 1 and 2, Block 1, Walnut Grove Pond, in accordance with the Plans received by the City on June 30, 2000. 2. Compliance with the City Engineer's Memo. 3. Submittal of required drainage and utility easement documents as approved by the City Engineer prior to filing of the lot division/lot consolidation. 4. Prior to filing the lot division/lot consolidation with Hennepin County, the City must vacate the existing drainage/utility easements that divide the two parcels. Resolution 2000-379 (20110) Page 4 of 5 ATTACHMENT TWO (EXISTING LEGAL DESCRIPTIONS) PARCEL A Lot 1 and that part of Lot 2, Block 1, WALNUT GROVE POND, according to the recorded plat thereof, which lies northerly of the following described line: Commencing at the northeast corner of said Lot 2; thence on an assumed bearing of S00°57'03"E, along the east line of said Lot 2, a distance of 21.40 feet, to an angle point in said east line, to the point of beginning of the line to be described; thence N88°45' 14"W a distance of 176.13 feet to a point in the west line of said Lot 2 distant 14.00 feet southerly from the northwest corner of said Lot 2 and said line there terminating. Reserving an easement for drainage and utility purposes over, under and across the south 6.00 feet of the above described property. Reserving an easement for drainage ad utility purposes over, under and across the easterly 6.00 feet of the above described property. PARCEL B That part of Lots 1 and 2, Block 1, WALNUT GROVE POND, according to the recorded plat thereof, which lies easterly of the following described line and its northerly and southerly extension. Beginning at a point on the north line of said Lot 1 distant 70.00 feet west from the northeast corner of said Lot 1; thence southerly to a point on the north line of said Lot 2 distant 76.00 feet west from the northeast corner of said Lot 2; thence southerly to a point on the south line of said Lot 2 distant 61.00 feet westerly from the southeast corner of said Lot 2 and said line there terminating.
