HomeMy WebLinkAboutCity Council Resolution 2010-008CITY OF PLYMOUTH RESOLUTION NO. 2010-008 AMENDED RESOLUTION NO. 86 - 462 APPROVING A SITE PLAN FOR RYAN CONSTRUCTION FOR GROVES OFFICE PARK PHASE 1 (86044) WHEREAS, Ryan Constriction Company has requested approval of a Site Plan for the constriction of a 14 -story, 250,000 square foot office building in the northwest quadrant of State Highway 55 and County Road 18 now described as follows: Lot 2, Block 1, Groves Office Park Annex, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the approval pertains to the property in the northwest quadrant of State Highway 55 and County Road 18 excluding the property legally described as follows: Lot 1, Block 1, Groves Office Park, according to the recorded plat thereof, Hennepin County, Minnesota. (abstract and torrens property, certificate of title no. 824711) The registered portion of the land is described as follows: That part of Lot 1, Block 1, Groves Office Park, embraced within the Southwest Quarter of the Northeast Quarter of Section 36, Township 118, Range 22. WHEREAS, the Planning Commission has reviewed said request and recommends approval; WHEREAS, Resolution 86-462 was recorded with the office of the County Registrar of Titles Hennepin County, Minnesota as Document No. 1756350 and the County Recorder as Document No. 5162325. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request for Ryan Constriction Company for a Site Plan for Phase I for the constriction of a 14 -story, 250,000 square foot office building in the northwest quadrant of State Highway 55 and County Road 18 excluding the property described above, subject to the following conditions: Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedication Policy in effect at the time of Building Permit issuance, based on calculations for that land at or above the 100 -Year High Water Elevation. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 4. Any signage shall be in compliance with the Ordinance. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions, and compliance with the approved PUD plan. 6. Compliance with the Fire Chief s Memorandum for the location of fire hydrants and fire lanes. 7. All waste and waste containers shall be stored within the compactor and no outside storage is permitted. 8. No building permit to be issued until the final plat is filed and recorded with Hennepin County. 9. Prior to occupancy of the building, a Condition Use permit shall be obtained for support services of employee fitness center, one -stall carwash rack, gift/sundry shop, and deli/sandwich shop restaurant. 10. Appropriate permits shall be obtained for the installation of the fountain, to be verified by the City Engineer. 11. Lot coverage of the stricture has been and will be calculated on the basis of that land at or above the High Water Elevation, established by the City Storm Water Drainage Plan as verified by the City Engineer. This resolution shall be filed on this property as a memorial to the property, indicating this was the basis for calculating lot coverage selected by the developer.
