RESOLUTION NO. 2000-348
AUTHORIZING THE VACATION OF
A SANITARY SEWER EASEMENT ACQUIRED AS PARCEL 44 IN PARTIAL
FINAL CERTIFICATE AND ORDER DOCUMENT NO. 3705296
WAYZATA SCHOOL DISTRICT
WHEREAS, a petition was received to vacate a sanitary sewer easement acquired as Parcel 44 in
partial final certificate and order Document No. 3705296; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for July 11, 2000 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of July 11, 2000; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on July 11, 2000 to inform any and all interested
parties relevant to the vacation of a sanitary sewer easement acquired as Parcel 44 in partial final
certificate and order Document No. 3705296; and
WHEREAS, it was determined by the City Council that said easement is not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following easement for a sanitary sewer easement

acquired as Parcel 44 in partial final certificate and order Document No. 3705296 purposes recorded
under Document No. 6357538 be vacated:
That part of the Southeast quarter of the Southeast quarter Section 34, Township
118 North of Range 22 West lying West of the East 272.22 feet thereof and
lying South of the Southerly right-of-way line of County Road No. 15.
Lying within a 60 foot strip of land centered upon the following described centerline:
Commencing at a point on the East line of the said Southwest quarter of the Southeast
quarter distant 620 feet North of the Southeast corner thereof, thence West parallel to
the South line of said Southeast quarter of the Southeast quarter for a distance of 183.76
feet, thence deflecting to the left at a deflection angle of 25 minutes 04 seconds for a
distance of 212.38 feet, thence deflecting to the right at a deflection angle of 59 degrees
51 minutes for a distance of 498.11 feet to a point hereinafter referred to as "Point A",
thence deflecting to the right at a deflection angle of 10 degrees 40 minutes to the
Southerly right-of-way line of Hennepin County Road No. 15; and commencing at the
above-described "Point A" thence deflecting to the right at a deflection angle of 85
degrees to the Southerly right-of-way line of Hennepin County Road No. 15 and there
terminating; and the Westerly 420 feet of the Northerly 30 feet of the above-described
parcel; and the Easterly 40 feet of the Westerly 450 feet of the Northerly 40 feet of the
above-described parcel.
And
Perpetual easements over that part of the above-described parcel lying within a 20 foot strip of
land centered upon the above-described centerline; and the Northerly 10 feet of the Westerly
430 feet of the above-described parcel; and the Easterly 20 feet of the Westerly 460 feet of the
Northerly 20 feet of the above described parcel.
