A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR 5505
VICKSBURG LLC, FOR "SPRING MEADOWS" FOR PROPERTY LOCATED AT 5505
VICKSBURG LANE (2009025-F)
WHEREAS, 5505 Vicksburg, LLC has requested approval of a final plat and development
contract to allow a subdivision containing 59 single-family lots and one amenity lot on the roughly
24.5 -acre site located at 5505 Vicksburg Lane, legally described as follows:
The Southeast Quarter of the Southeast Quarter of Section 5, Township 118, Range 22,
Hennepin County, Minnesota, except the South 526.00 feet thereof.
WHEREAS, City staff has prepared a development contract covering the improvements related to
said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by 5505 Vicksburg, LLC for a final plat for Spring Meadows; and
FURTHER, that the development contract for said plat be approved, and that upon prior
execution of the development contract by the developer, the Mayor and City Manager be
authorized to execute the development contract on behalf of the City; and
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. A final plat is approved for the creation of 59 single-family lots and one amenity lot for Spring
Meadows, in accordance with the plans received by the City on November 19, 2009, and the
plat received by the City on December 18, 2009, except as may be amended by this resolution.
2. Prior to recording the final plat, the applicant shall execute a Development Contract for the
public and private improvements, and shall submit the required financial guarantees.

3. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the
required information, and revise the plans as indicated below, consistent with the applicable
City Code, Zoning Ordinance, and Engineering Guidelines:
a. Zoning Ordinance/City Code requirements:
(1) Payment of park dedication fee in lieu of land dedication for 59 dwelling units, in
accordance with the dedication ordinance in effect at the time of recording of the
final plat. If the amenity lot (Lot 17, Block 2) is converted to single-family
residential use at any time in the fiiture, the park dedication fee for one dwelling
unit shall be paid for that lot prior to issuance of the building permit for a home, in
accordance with the dedication ordinance in effect at the time of issuance of such
permit.
(2) The existing strictures shall be removed from the site. Demolition permits are
required for removal of existing strictures.
b. Fire Code requirements:
(1) The emergency access road in the southeast portion of the site shall be at least 15
feet wide. The slope on this access road shall be minimized to the extent possible
and the landing areas at each end shall be kept as flat as possible. This access road
shall be cleared of snow and kept free of obstructions at all times. This access
road shall also include "No Parking" fire lane signage.
(2) Add one hydrant between Lots 27 and 28 of Block 4.
c. Assessment/easement/agreement/permit requirements:
(1) Payment of watermain area charges in the amount of $86,115.75
(2) Payment of sanitary sewer area charges in the amount of $23,208.50
(3) Separate unobstructed maintenance access easements are required for Retention
Area 1 and for the inlets and outlet for the water quality pond. The accesses must
be 15 feet wide, and have a slope of less than ten percent with a 12 -foot wide
driving surface capable of supporting maintenance equipment.
(4) A separate ten -foot wide trail easement along the east side of properties abutting
Vicksburg Lane within the plat.
(5) Copies of recorded easements over private properties along Vicksburg Lane
between the south boundary of the Wood Crest of Plymouth development and the
south side of the Canadian Pacific railroad crossing for the 20 -inch watermain.
(6) Evidence of a permanent easement and a temporary grading easement from the
O'Donnell property to the west (PIDs 05-118-22-43-0002 and 05-118-22-43-
0003) for a temporary cul-de-sac. Also, a permanent drainage and utility easement
for the discharge from the storm sewer line in the southwest corner of the Spring
Meadows Plat.

(7) A permanent access easement to the watermain on the Svetc property (PID 09-
118-22-22-0004).
(8) A maintenance agreement is required for Retention Area 1.
(9) The developer shall submit homeowners association documents for City review, to
ensure maintenance of any association common spaces, the private lift station,
retention area, infiltration/filtration basins, rear yard draintile, sidewalks,
landscaped medians, retaining walls, and similar features.
(10) Operation of the proposed sanitary sewer lift station and forcemain shall not
interfere with operation of the existing lift station and forcemain in the Wood Crest
of Plymouth development. Submit hydraulic calculations and pump curve that
demonstrate this. A maintenance agreement between the Spring Meadows and
Wood Crest of Plymouth developments is required for the forcemain downstream
of the junction point.
(11) An action plan for emergency notification procedures is required by the City for
the privately maintained temporary sanitary sewer lift station. Literature shall be
provided to prospective home owners of this. The lift station must have a warning
light on top which comes on when the system is not fiinctioning properly. An
emergency telephone number must be visibly displayed. The contact shall be
available for emergencies 24 hours per day, 365 days per year.
(12) The developer shall maintain the private sanitary sewer lift station and related
system for at least five (5) years from the date that the first home in the subdivision
is occupied. The developer may turn over the maintenance responsibility of the
private sanitary sewer lift station and related system to the Spring Meadows
homeowner's association after that time. Information regarding this shall be
disclosed to potential home buyers and shall be addressed in the homeowner's
association documents.
(13) If and when the Spring Meadows homeowner's association would take over
maintenance responsibility for the private sanitary sewer lift station and related
system, the homeowner's association shall demonstrate an ability to maintain the
system, and shall address maintenance of the system in the homeowner's
association budget. Information regarding this shall be disclosed to potential home
buyers and shall be addressed in the homeowner's association documents.
(14) In the event that the developer or homeowner's association is unable to maintain
the private sanitary sewer lift station, the City shall have the right to do so and
assess or otherwise charge the costs to the homeowners within the development.

(15) Necessary permits and approvals from other agencies: Hennepin County for
abandoning the septic system, MPCA for extending the sanitary sewer, Minnesota
Department of Health for extending the watermain and capping the well(s),
Wetland Conservation Act, Shingle Creek Watershed, NPDES, and Canadian
Pacific Railroad for water main crossing of the railroad tracks.

d. Grading and erosion control plans:
(1) Provide additional detail if the retention area will have plantings installed.
(2) Add note "Refer to ST -26 on page 8" to entrance of temporary access road.
(3) A geotechnical report to address wetland fill shall be provided in conjunction with
submittal of the building permit for the homes on Lots 1 and 2 of Block 3, and
Lots 16 and 17 of Block 4. The report shall be prepared by a certified engineer
licensed by the State of Minnesota.
e. Street and utility plans:
(1) Remove "No crushed concrete" from Detail STRT-2 on Sheet 2 (Final Street
Plan).
(2) Show hazard (OMI -2), "Keep Right" (R4-7) and delineator signs in median at 55"'
Avenue.
(3) Install a culvert under the driveway entrance to the lift station.
(4) Indicate striping size, color and starts and stops on Sheet 6 (Final Turn & Bypass
Lane Plan). Text is not required for directional arrows.
(5) Add "Right Turn Lane" sign on shoulder of southbound Vicksburg Lane at the
beginning of the right turn lane. Add "Begin Bypass Lane" sign on the shoulder of
northbound Vicksburg Lane at the beginning of the by-pass lane.
(6) Add to Note 6 and 7 on Sheet 6: per MnDOT "Temporary Traffic Control Zone
Layouts" current addition.
(7) Add Note 9 to Sheet 6: Single lane closures shall only occur on weekdays
between 9:00 a.m. and 3:00 p.m.
(8) Add 8 -inch gate valve on 8 -inch watermain at station 10+50 (approximately 10
feet east).
(9) On Sheet 7 and 8, move 18 -inch gate valve shown at station 14+00 to station 0+75
on 55"' Avenue.
(10) Tie all joints on 12 -inch RCP between stricture OS -1 and inlet FES.
(11) All existing storm sewer pipes not being removed must fiunction after roadwork
has been completed.
(12) Show location of concrete trick wash-out area on Sheet 16.
(13) On Sheet 18 under ON SITE BMP's Note 9: remove "as needed" and add "more
frequently".
(14) Add note to detail W-2 and W-4, 46 universal base (ribber).
(15) On Trunk Watermain Plan (Sheet 2): Move 20 -inch gate valve at Station 17+20
to Station 15+30.
(16) Add "Single lane work to be done only between 9:00 a.m. and 3:00 p.m.
weekdays" under notes on Sheet 1, 2 and 3 of Trunk Watermain Plan.
(17) Remove note indicating "8 -inch plug with tail" from Sheet 2 of the Trunk
Watermain Plan at approximately Station 11+00.

(18) After the trunk watermain has been installed, restore the Wuertz property (PID 04-
118-22-32-0004) with sod.
(19) Provide a larger separation between stricture A-4 and stricture OS -1.
(20) Consider moving the garage and driveway to the east on Lot 6, Block 4.
(21) Lengthen vertical curve in Xene Lane cul-de-sac and Weston Lane north of 55"'
Avenue.
(22) Indicate Vicksburg Lane gravel shoulder thickness.
(23) Horizontal and vertical bends shall be no greater than 22'/2 degrees on the 18 -inch
and 20 -inch watermains.
(24) Submit a plan to bypass the Wood Crest of Plymouth lift station when the
forcemain connection is made and tested.
(25) Adjust two existing storm sewer manholes in the north bound Vicksburg bypass
lane.
(26) Connect retention area emergency overflow (EOF) to the existing storm sewer
manhole along Vicksburg Lane.
(27) Protect existing 21 -inch reinforced concrete pipe (RCP) on the south side of the
railroad tracks when connecting to existing 20 -inch doctile iron pipe (DIP)
watermain.
(28) Street restoration will be required immediately after the trunk watermain
installation in front of the Jensen property (PID 04-118-22-32-0003).
f. Water resource plan:
(1) Volume control must be demonstrated for the 2 -year 24 hour event. Hydrocad
modeling indicates an existing runoff volume of 1.032 acre feet and a proposed
runoff volume of 1.649 acre feet. Deducting the storage area of the retention area,
the proposed runoff volume is 1.573 acre feet, which exceeds the pre -development
conditions. The site must retain the additional volume created by the project for
the 2 -year event. Soil amendments, soil ripping, and compost application should
be considered as BMP's.
(2) Existing total suspended solids (TSS) and phosphorus export for the site must be
provided. TSS and phosphorus removal calculations must include the entire site,
not just "Pond 1".
(3) Units of measurement are wrong for several modeled ponds (e.g., the summary for
Pond E5 indicates storage of 123,000 acres). Make corrections as necessary.
4. Prior to issuance of a grading permit, the applicant shall install tree protection fencing
around the trees to be preserved.
5. A building permit for Lot 1, Block 4 shall not be issued until an alternative emergency access
or permanent access to Vicksburg Lane is provided to the south.

6. The applicant shall notify potential buyers about future roadway extensions and about the
future street improvement project for Vicksburg Lane, and shall post signage on the site
regarding such fiiture roadway improvements.
7. Lots 1-4 of Block 4 are in the shoreland overlay district and shall not exceed 25 percent
impervious surface coverage.
8. The number of dwelling units within this plat that are above the minimum density guidelines,
as specified by the Comprehensive Plan, may be applied to the adjacent roughly 30 -acre
Taylor site (located east of Vicksburg Lane -- PIDs 04-118-22-33-0004 and 04-118-22-33-
0005) if developed by the same developer as part of a fiiture development phase.
9. Standard Conditions:
a. No building permits shall be issued until the final plat is filed and recorded with Hennepin
County.
b. Development standards shall be as required by the RSF-3 district. No variances are
granted or implied.
c. Building permits are required for retaining walls 48 inches in height or higher.
Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in
height.
d. Any signage shall require separate permits and shall comply with the City's signage
regulations.
e. Compliance with the City's tree preservation regulations.
f. Removal of all hazardous trees from the property at the owner's expense.
g. This approval shall expire two years after the date of approval, unless the property owner
or applicant has recorded the final plat, or unless the landowner or applicant has received
prior approval from the City to extend the expiration date for up to one additional year, as
regulated under Section 512 of City Code.
