HomeMy WebLinkAboutCity Council Resolution 2000-338CITY OF PLYMOUTH RESOLUTION 2000-338 APPROVING A SITE PLAN AND VARIANCES FOR DELANO ERICKSON ARCHITECTS FOR AN OFFICE BUILDING LOCATED ON PROPERTY ON THE NORTH SIDE OF 37TH AVENUE BETWEEN VICKSBURG LANE AND PLYMOUTH BOULEVARD (20079) WHEREAS, Delano Erickson Architects has requested approval of a site plan and variances to allow development of an office building on property legally described as follows: Lot 3, Block 1, Plymouth Hills 3rd Addition, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Delano Erickson Architects for a site plan and variances for property located on the north side of 37th Avenue between Vicksburg Lane and Plymouth Boulevard, subject to the following conditions: A site plan and variances for a office building is hereby approved, in accordance with the application and plans received by the City on May 26, 2000 and revisions received on June 26, 2000, except as amended by this resolution. 2. A variance from the City Center district building massing requirements is approved, with the finding that the applicable variance standards are met. A variance from the City Center district requirements that the third floor be stepped back at a 1:1 ratio is approved, based on the finding that applicable variance standards have been met. 4. A variance is approved for 13.8 percent building coverage where 15 percent coverage is the minimum building coverage required in the City Center district, based on the finding that the applicable variance standards have been met. Resolution 2000-338 (20079) Page 2 5. The landscape plan shall be revised to provide two additional tree for a total of 66 new trees. 6. All crosswalks shall be a brick -patterned concrete. 7. The applicant will work with staff to design the plaza area in the front of the building, which is consistent with the City's Plan for public spaces. The plaza in this area will include benches and special paving. 8. All signage shall comply with the sign regulations identified in Section 21155 of the Zoning Ordinance. 9. Prior to issuance of building permits, the applicant shall prepare a revised lighting plan that indicates compliance with Section 21105.06 of the Zoning Ordinance. The revised lighting plan shall include details for site lighting including freestanding and building lighting. 10. The applicant must obtain the appropriate permits from the Building Division prior to commencing any work on the building. 11. All rooftop and ground mounted mechanical equipment shall be designed (including exterior color) and located so to be aesthetically harmonious and compatible with the building. Rooftop equipment over three (3) feet in height shall be screened with durable materials which are aesthetically compatible with the structure. In no case shall wooden fencing be used as a rooftop equipment screen. 12. The applicant must provide the City with a copy of the cross-access/easement agreement for shared driveway on the east. 13. The applicant shall comply with the conditions outlined in the City Engineer's memorandum. 14. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 15. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 16. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning Ordinance. 17. Standard Conditions: a. The applicant shall submit the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. Resolution 2000-338 (20079) Page 3 b. The applicant shall remove all hazardous trees from the property at the owner's expense. c. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. d. Prior to issuance of building permits, the applicant shall submit fire flow calculations. e. The applicant shall submit an 8 1/2 x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement bonds per City Policy.
