RESOLUTION 2000-328
APPROVING FINDINGS OF FACT FOR REZONING FOR NORTH AMERICAN
PROPERTIES FOR PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF
VICKSBURG LANE AND HIGHWAY 55 (20040)
WHEREAS, North American Properties, Inc. has requested reclassification of the zoning from O-
R (Office/Residential) to PUD (Planned Unit Development) and CC -RE (City Center,
Retail/Entertainment) for property legally described as follows:
Outlot I, Sugar Hills Addition, according to the recorded plat thereof, Hennepin County,
Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommended approval; and,
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from O -R to
PUD and CC -RE;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does support the request by North
American Properties, Inc. for reclassification of the zoning from O -R (Office/Residential) to PUD
(Planned Unit Development) and CC -RE (City Center, Retail/Entertainment) for property located
at the northwest quadrant of the intersection of Vicksburg Lane and Highway 55, based on the
following findings:
1. The proposed rezoning to PUD and CC -RE is consistent with the Comprehensive Plan and
other City policies and plans.
2. The proposed development meets the intent of the PUD zoning district by providing an
efficient use of land by incorporating a mixture of uses in a neighborhood (townhouses around
an existing commercial building).
3. The proposed development meets the intent of the PUD zoning district by creating a
neighborhood with both commercial and residential uses, which would not otherwise be
possible through strict interpretation of the Zoning Ordinance.
4. The proposed development meets the standards of the CC -RE (City Center,
Retail/Entertainment) zoning district.
5. There is adequate infrastructure to support the proposed development and rezoning of the
parcel.
