HomeMy WebLinkAboutCity Council Resolution 2000-252CITY OF PLYMOUTH RESOLUTION 2000-252 APPROVING FINDINGS OF FACT FOR AMENDING THE ZONING ORDINANCE TEXT FOR THE PLYMOUTH STATION PUD, LOCATED SOUTH OF HWY 55, NORTH OF MEDINA ROAD AND EAST OF CO. RD. 24 (20042) WHEREAS, Aramark Education Resources, Inc. has requested a PUD (Planned Unit Development) general plan amendment for property legally described as: Lot 1, Block 1, Plymouth Station, Hennepin County, Minnesota described as follows: Commencing at the southeast corner of said Lot 1; thence South 88 degrees 56 minutes 41 seconds West, assumed bearing along the south line of said Lot 1 a distance of 64.50 feet to the point of beginning of the land to be described; thence North 1 degree 03 minutes 19 seconds West 132.00 feet; thence North 68 degrees 29 minutes 19 seconds West 21.00 feet; thence North 21 degrees 52 minutes 19 seconds West 73.00 feet; thence North 86 degrees 08 minutes 19 seconds West 217.00 feet; thence South 18 degrees 00 minutes 21 seconds West 205.67 feet to said south line of Lot 1 thence easterly along said south line 245.07 feet being a nontangential curve concave to the north having a radius of 918.51 feet, a central angle of 15 degrees 17 minutes 14 seconds and a chord that bears South 83 degrees 24 minutes 41 seconds East; thence continuing along said south line tangent to said curve North 88 degrees 56 minutes 41 seconds East a distance of 86.53 to the point of beginning. WHEREAS, the Plymouth Zoning Ordinance requires a text amendment for a PUD Amendment; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance amending the Zoning Ordinance text for the affected parcels. Resolution 2000-252 (20042) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does support and approve the request by Aramark Educational Resources, Inc. for a PUD general plan amendment and related Zoning Ordinance text amendment, based on the following findings: 1. The proposed use of the property is consistent with the Comprehensive Plan. 2. The extension of the phasing plan until October 31, 2001 would allow completion of the day care building consistent with the PUD zoning district. 3. The location of the day care is consistent with the original PUD general plan, which required the less intense commercial uses to be located adjacent to the residential properties. 4. The PUD amendment would not require any changes to the utility, landscaping, lighting, or grading plans. ADOPTED by the City Council on May 9, 2000. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
