ENTERPRISES FOR A BANK/OFFICE BUILDING WITH DRIVE-THROUGH LOCATED ON PROPERTY ON THE WEST SIDE OF PLYMOUTH BOULEVARD NORTH OF 34TH AVENUE (20032) WHEREAS, H. I. Enterprises, Inc. has requested approval of a site plan and variances to allow development of a bank/office building with drive-through on property legally described as follows: Lot 3, Block 4, Plymouth Hills WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by H. I. Enterprises for a site plan and variances for property located on the west side of Plymouth Boulevard north of 34th Avenue, subject to the following conditions: 1. A site plan and variances for a office/bank building is hereby approved, in accordance with the application and plans received by the City on March 16, 2000 and revision received on April 24, 2000, except as amended by this resolution. 2. Approval of the site plan and variances is contingent upon City approval of the rezoning of the site to CC -R (City Center—Retail). 3. A setback variance is approved for a 32 -foot front yard setback where 20 feet is the maximum front yard setback permitted in the City Center district, with the finding that the applicable variance standards are met. Variances are approved for more than 50 percent of the parking in front of the rear building line to the front yard lot line and parking at the point of street intersections based on the finding that applicable variance standards have been met. 5. A variance is approved for 12 percent building coverage where 15 percent coverage is the minimum building coverage required in the City Center district, based on the finding that the applicable variance standards have been met. 6. The plans shall be revised to provide six-foot sidewalks along the two street frontages. 7. All crosswalks shall be a brick -patterned concrete. 8. The applicant shall comply with the City's tree preservation regulations. 9. The landscape plan shall be revised to provide sugar maples along the entire perimeter of the site, including the southeast corner of the site. 10. The landscape plan shall be revised to replace the proposed junipers along 34th Avenue with alpine current. 11. The applicant will work with staff to design landscaping in the southeast corner of the site which is consistent with the City's Plan for public spaces. The landscaping in this area will include benches and plant materials. 12. The applicant should provide building wall signage on the east elevation of the building to provided identification for pedestrians entering from Plymouth Boulevard. 13. All signage shall comply with the sign regulations identified in Section 21155 of the Zoning Ordinance. 14. Prior to issuance of building permits, the applicant shall prepare a revised lighting plan that indicates compliance with Section 21105.06 of the Zoning Ordinance. The revised plan shall include an additional light pole at the south end of the south parking area. The revised lighting plan shall include all site lighting including building and canopy lighting. 15. The applicant must obtain the appropriate permits from the Building Division prior to commencing any work on the building. 16. All rooftop and ground mounted mechanical equipment shall be designed (including exterior color) and located so to be aesthetically harmonious and compatible with the building. Rooftop equipment over three (3) feet in height shall be screened with durable materials which are aesthetically compatible with the structure. In no case shall wooden fencing be used as a rooftop equipment screen. Resolution 2000-249 (20032) Page 3 17. The applicant shall comply with the conditions outlined in the City Engineer's memorandum. 18. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 19. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 20. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning Ordinance. 21. Standard Conditions: a. The applicant shall submit the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. b. The applicant shall remove all hazardous trees from the property at the owner's expense. c. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. d. Prior to issuance of building permits, the applicant shall submit fire flow calculations. e. The applicant shall submit an 8 1/2 x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement bonds per City Policy.
