HomeMy WebLinkAboutCity Council Resolution 2000-153CITY OF PLYMOUTH RESOLUTION 2000-153 APPROVING SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT FOR LOUCKS & ASSOCIATES FOR A WIRELESS COMMUNICATION POLE LOCATED AT 4455 State Highway 169 (20015) WHEREAS, Loucks and Associates has requested approval of a site plan amendment and conditional use permit to allow the erection of a 72 -foot high wireless communication pole on property legally described as follows: Lot 2, Berg 2nd Addition, except that part which lies west of a line described as beginning at the southeast corner of Lot 1, Berg 2nd Addition, thence south parallel with west line of said Lot 2 to its intersection with the south line of said Lot 2 and there terminating. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Loucks and Associates for a site plan amendment and conditional use permit for property located at 4455 Highway 169, subject to the following conditions: 1. A site plan amendment and conditional use permit for a 72 -foot high wireless communication pole is hereby approved, in accordance with the application and plans received by the City on February 7, 2000, except as amended by this resolution. 2. Prior to issuance of building permits, the applicant shall revise the plans to show the arm antenna attachments. 3. A copy of the relevant portions of a signed lease or other agreement which specifies that the pole owner and his or her successors will allow the shared use of the pole if an additional user agrees in writing to meet reasonable terms and conditions for shared use. The relevant portions of the lease or agreement shall be submitted prior to issuance of a building permit. Resolution 2000-153 (20015) Page 2 of 3 4. A copy of the relevant portions of a signed lease or other agreement that requires the applicant to remove the pole and associated facilities when they are abandoned, unused or become hazardous shall be submitted to the City prior to issuance of a building permit. 5. Any additional antennas on the pole shall require the issuance of an administrative permit. 6. The applicant shall obtain a building permit prior to erecting the pole and accessory equipment. 7. The pole shall be painted a non -contrasting color or have a galvanized finish. 8. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 9. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 10. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction or operation of the project/use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
