RESOLUTION No. 2011-426
A RESOLUTION ABATING SPECIAL ASSESSMENT
COUNTY ROAD 101 RECONSTRUCTION PROJECT
CITY PROJECT NO. 5102
WHEREAS, on July 12, 2011, the City Council approved Resolution No. 2011-227 adopting
assessments for the improvement of Hennepin County Road 101 from 13th Avenue to 30t1' Avenue
known as City Project No. 5102; and
WHEREAS, Sammy K. Allen and Janis E. Allen, husband and wife (the Allens), are owners
of property located at 2045 Merrimac Lane North and described as Hennepin County P.I.D. No. 30-
118-22-14-0021 (the Subject Property); and
WHEREAS, on August 2, 2011, the Allens filed a Summons and Complaint and Notice of
Appeal to Special Assessment with the Hennepin County District Court (Court File No. 27 -CV -11-
15936) objecting to the City's assessment of $8,312.38 against the Subject Property; and
WHEREAS, in settlement of the above lawsuit, the City entered into an agreement with the
Allens that the City would abate the special assessment on the Subject Property for Project No. 5102.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH AS FOLLOWS:
The special assessment for Project 5102 which was assessed against P.I.D. No. 30-118-22-
14-0021 in the principal amount of $8,312.38 is abated.
