RESOLUTION No. 2011-412
A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT AMENDMENT
FOR "ELM CREEK HIGHLANDS EAST SECOND ADDITION" FOR PROPERTY LOCATED
NORTH OF SCHMIDT LAKE ROAD AND JEWEL LANE (2011093-F)
WHEREAS, on July 26, 2011, the City Council approved the final plat and development
contract for the Elm Creek Highlands East subdivision for 37 new single-family lots within the
southerly portion of that plat and three outlots, legally described as follows:
Lots 1 through 3, Block 1, Elm Creek Highlands East, Hennepin County, Minnesota; and
Lots 1 through 24, Block 2, Elm Creek Highlands East, Hennepin County, Minnesota; and
Lots 1 through 10, Block 3, Elm Creek Highlands East, Hennepin County, Minnesota; and
Outlots A, B, and C, Elm Creek Highlands East, Hennepin County, Minnesota.
WHEREAS, on November 14, 2011, Pulte Homes requested a re -plat of the Elm Creek
Highlands East subdivision named "Elm Creek Highlands East Second Addition"; and
WHEREAS, Elm Creek Highlands East Second Addition allows minor adjustments to
interior lot lines from the Elm Creek Highlands East subdivision.
WHEREAS, city staff has prepared a development contract amendment covering the
changes related to said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by Pulte Homes for a final plat and development contract amendment for
Elm Creek Highlands East Second Addition; and
FURTHER, that upon prior execution of the development contract amendment by the
developer, the Mayor and City Manager be authorized to execute the development contract
amendment on behalf of the City.
FURTHER, that the following conditions be met prior to recording of, and related to said
plat:
1. The final plat for Elm Creek Highlands East Second Addition is approved in accordance with
the plans received by the city on November 14, 2011, except as may be amended by this
resolution.

2. Resolution 2011-245 approving the final plat for Elm Creels Highlands East, and its related
development contract and first amendment to the development contract shall remain in full
force and effect, except as specifically amended by this resolution.
3. The final plat is contingent on city council approval of the vacation of easements on the Elm
Creels Highlands East Plat.
4. Prior to recording the final plat, the applicant shall execute the development contract
amendment, known as "Second Amendment to Development Contract' related to said plat.
5. Prior to issuance of building permits, the developer shall provide written disclosure to the
buyers of all lots in the development that would not be allowed to have a building/porch
addition on the back side of their house due to city setback requirements. The developer
shall provide the city with a copy of the disclosure materials prior to issuance of building
permits for new house constriction for the applicable lots.
