A RESOLUTION TO APPROVE ENCROACHMENT AGREEMENT
FOR RETAINING WALLS WITHIN PLATTED DRAINAGE AND UTILITY EASEMENTS IN
WOOD CREST OF PLYMOUTH 2"D ADDITION
WHEREAS, the owner of Wood Crest of Plymouth 2" a Addition, Landmark 31 of Plymouth,
LLC, has requested the City to approve an encroachment agreement allowing retaining walls within
platted drainage and utility easements in Wood Crest of Plymouth 2" a Addition; and
WHEREAS, the encroachment agreement permits only the proposed retaining walls within
the easements and all related facilities must still meet all applicable City codes; and
WHEREAS, the owners property is legally described as Lots 1 through 11, Block 1, Lots 1
through 4, Block 2, Lots 1 through 17, Block 3, Lot 1, Block 4, Lot 1, Block 5 and Outlot A, Wood
Crest of Plymouth 2" a Addition.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL, OF THE CITY
OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth, the encroachment agreement that will allow retaining walls within platted
drainage and utility easements on Lots 5 through 8, Block 1, Lots 1 through 4, Block 2 and Lots 11 and
16, Block 3, Wood Crest of Plymouth 2"a Addition.
