RESOLUTION No. 2011-382
A RESOLUTION APPROVING A VARIANCE FOR PHOENIX SIGNS TO EXPAND THE EXISTING
OFF-SITE DIRECTIONAL SIGN LOCATED AT 3015 HARBOR LANE NORTH (2011086)
WHEREAS, Phoenix Signs has requested approval of a variance to allow an eight square
feet of off-site directional signage, where four square feet is the maximum allowed by the zoning
ordinance; and
WHEREAS, the subject property is legally described as follows:
That parts of Lots 4 and 5, Block 1, FOX MEADOWS FIRST ADDITION, according to
the recorded plat thereof, Hennepin County, Minnesota lying southeasterly and easterly
of the following described line.
Commencing at the northwest corner of Lot 6, Block 1, FOX MEADOWS FIRST
ADDITION; thence on an assumed bearing of south 00 degrees 44 minutes 45
seconds west, along the west line of Lots 5 and 6, a distance of 355.00 feet;
thence south 89 degrees 15 minutes 15 seconds east a distance of 444.00 feet;
thence north 00 degrees 44 minutes 45 seconds east a distance of 21.00 feet to a
point hereinafter referred to as Point A; thence north 45 degrees 44 minutes 45
seconds east to the intersection with the southwesterly line of Harbor Lane, as
platted in said FOX MEADOWS FIRST ADDITION, 157.50 feet to the point of
beginning of said line; thence south 45 degrees 44 minutes 45 seconds west
157.50 feet to said Point A; thence south 00 degrees 44 minutes 45 seconds west
105.67 feet; thence south 24 degrees 41 minutes 06 seconds west 233.24 feet to
the intersection with the south line of said Lot 4 and said line there terminating.
Except that part of said Lot 4 lying southeasterly of line 104.65 feet northwesterly
of, measured at a right angle to and parallel with the southeasterly line of said Lot
4 and its extensions.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Phoenix Signs for a variance to allow a four square foot expansion to the existing four
square foot off-site directional sign located at 3015 Harbor Lane North, subject to the following:
1. The requested variance is hereby approved, in accordance with the application received by
the city on October 21, 2011, except as may be amended by this resolution.

2. The requested variance is approved, based on the finding that all applicable variance
standards have been met, specifically:
a) The requested variance would be in harmony with the general purposes and intent of
the ordinance, and would be consistent with the city's comprehensive plan.
b) The applicant has demonstrated that there are practical difficulties in meeting the
surface area requirement, because:
1. The applicant proposes to use the property in a reasonable manner;
2. The request is due to unique circumstances that were not created by the
applicant. Given the position of the building on the site with 300 feet of
separation from Harbor Lane to the building, there is no signage visible from
Harbor Lane that would identify where Memorial Blood Centers is located.
Directional signage is important for a business like a blood center where you
have turn -over of people that have not been to the site before. Given that
there is already a four square foot directional sign with the building name and
address, meeting the four square foot requirement to add a sign for Memorial
Blood Center is a practical difficulty;
3. The variance would not alter the essential character of the lot or surrounding
area. Most of the surrounding businesses along Harbor Lane have business
signage facing the street. Therefore, the proposed additional four square feet
of directional sign would not be out of character with the surrounding area.
c) The requested variance is not based exclusively upon economic considerations. The
applicant is proposing to constrict a directional sign for people to have an easier time
finding Memorial Blood Centers.
d) The variance would not impair an adequate supply of light and air to adjacent
properties, nor would it increase traffic congestion or the danger of fire, endanger the
public safety, or substantially diminish property values within the neighborhood.
e) The variance requested is the minimum action required to address the practical
difficulties.
3. A sign permit and an electrical permit are required prior to commencement of the
rp olect.
4. The variance shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project, or unless the landowner or
applicant has received prior approval from the city to extend the expiration date for up to
one additional year, as regulated under section 2 103 0. 06 of the zoning ordinance.
