HomeMy WebLinkAboutCity Council Resolution 2000-147CITY OF PLYMOUTH RESOLUTION 2000-147 APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY LOCATED ON KILMER LANE SOUTH OF 36TH AVENUE AND NORTH OF 34TH AVENUE (20014 AND 20026) WHEREAS, Mid -Co AV and the City of Plymouth have requested reclassification of the zoning from C-3 (Highway Commercial) to C-5 (Commercial/Industrial) for 11 parcels located on Kilmer Lane, legally described as follows: Lots 1-9, Block 1 and Lots 7-11, Block 2, Glen Erie, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcels from C-3 (Highway Commercial) to C-5 (Commercial/Industrial). NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from C-3 (Highway Commercial) to C-5 (Commercial/Industrial) for 11 parcels of land located on Kilmer Lane, based on the following findings: 1. The proposed rezoning is consistent with the comprehensive plan and other City policies and plans. 2. The existing development is consistent with the uses permitted in the Commercial/Industrial zoning district. 3. The proposed Commercial/Industrial zoning would allow continuation of the existing uses. The proposed rezoning would eliminate several non -conforming uses. There is adequate infrastructure available to support the Commercial/Industrial zoning and both the existing and proposed commercial development in this area.
