HomeMy WebLinkAboutCity Council Resolution 2011-352CITY OF PLYMOUTH RESOLUTION No. 2011-352 A RESOLUTION AUTHORIZING THE VACATION OF A PORTION OF A DRAINAGE AND UTILITY EASEMENT WITHIN LOT 2 OF BLOCK 1, FRETHAM SIXTH ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for October 11, 2011 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of October 11, 2011; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the City Council did hold a public hearing on October 11, 2011 to inform any and all interested parties relevant to the vacation of a portion of a drainage and utility easement within Lot 2 of Block 1, Fretham Sixth Addition; and WHEREAS, it was determined by the City Council that said portion of the easement is not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of a drainage and utility easement within Lot 2 of Block 1, Fretham Sixth Addition, be vacated: The north 8.00 feet of that particular drainage and utility easement, originally reserved in Document No. 4557125, Office of the County Recorder, Hennepin County, Minnesota, described as follows: All that part of 19th Avenue between the east line of East Medicine Lake Boulevard and the west line of Kilmer Lane. Which lies westerly of the easterly 30.00 feet of Lot 2, Block 1 Fretham Sixth Addition according to the recorded plat thereof, Hennepin County, Minnesota, and easterly of a line described as follows: Commencing at the most westerly corner of said Lot 2; thence on an assumed bearing of South 21 degrees 54 minutes 24 seconds West, along the westerly line of said Lot 2. a distance of 37.03 feet; thence North 89 degrees 39 minutes 28 seconds East a distance of 3 1. 79 feet to the point of beginning of the line to be described; thence South 05 degrees 28 minutes 27 seconds East a distance of 8.03 feet to the south line of the north 8.00 feet of said drainage and utility easement, and said line there terminating. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
