TO ALLOW FOUR -FOOT EIGHT -INCH HIGH SPLIT RAIL CEDAR FENCING AT THE ENTRANCES TO THE PLUM TREE EAST (WYNDEMERE FARMS) PUD, LOCATED NORTH OF OLD ROCKFORD ROAD, SOUTH OF THE SOO LINE RAILWAY, EAST OF PEONY LANE, AND WEST OF HOLLY LANE (99133) WHEREAS, Lundgren Bros. Construction, Inc. has requested approval of a PUD Amendment to allow decorative entrance fencing for property legally described as follows: Outlots A and B, Plum Tree East; Outlots A and B, Plum Tree East 2nd Addition; and, Outlots A and B, Plum Tree East 3rd Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lundgren Bros. Construction, Inc. for a PUD Amendment to allow entrance fencing at the Plum Tree East (Wyndemere Farms) PUD, subject to the following conditions: 1. A PUD Amendment is approved in accordance with the application and plans received by the City on December 15, 1999, except as amended by this resolution. 2. Prior to installation of the fencing, the applicant shall obtain a fence permit from the Building Division. 3. Prior to issuance of the fence permit, the applicant shall demonstrate that they have completed any necessary amendments to the homeowner association documents to specifically address the ownership and long-term maintenance of the fencing. Resolution 2000-110 (99133) Page 2 4. Prior to installation of the fencing, the applicant shall contact Gopher One to locate any utilities that may be in the area of the proposed fencing.
