HomeMy WebLinkAboutCity Council Resolution 2000-109CITY OF PLYMOUTH RESOLUTION 2000-109 APPROVING SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCE FOR QUINWOOD SQUARE, LLC FOR A CULVER'S RESTAURANT FOR PROPERTY LOCATED NORTH OF BASS LAKE ROAD AND WEST OF QUINWOOD LANE NORTH (99125) WHEREAS, Quinwood square, LLC has requested approval of a site plan, conditional use permit and variance to allow construction of a 4,538 square foot restaurant with drive -up window on property legally described as follows: Lot 2, Block 1, Maple Grove Center 2nd Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the site plan, conditional use permit and variance. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the site plan, conditional use permit and variance for a Culver's Restaurant on property located north of Bass Lake Road and west of Quinwood Lane North, subject to the following conditions: 1. A site plan and conditional use permit are approved to allow construction of a 4,538 square foot restaurant, in accordance with the plans received by the City on December 30, 1999, except as amended by this resolution. 4.2.A variance is approved for two wall signs according to the application and plans- - - - Formatted: Bullets and Numbering received on December 30, 1999, based on the following findings: a. The hardship is based on the fact that this site is functionally a corner lot, and therefore, would normally be allowed to have wall signage on two walls. However, because the roadway to the north is a private street, the site technically has frontage on only one public street (Quinwood Lane). The service road Resolution 2000-109 (99125) Page 2 functions and is designed as a public street, but is platted as an outlot within the city limits of Maple Grove. Furthermore, the main front door of the proposed restaurant would be located on the north building wall, which faces the service road. Many customers may approach the restaurant from the north, through the Maple Grove Mall site. In those instances, the wall signage proposed for the north wall is essential to provide identification for the building, because the pylon sign located in the southeast corner of the site would be blocked by the building. Additionally, the wall signage proposed for the east wall is essential to provide identification for the building when approaching from Quinwood Lane. b. The conditions surrounding this variance request are somewhat unique to this parcel, because the street that provides the main access point to the this site is a private service road. This condition is not applicable, generally, to other properties in the C-4 district. c. The purpose of the variance is not to increase value or income potential. The purpose of the variance relates simply to the need to provide clear building identification from the two streets abutting the site. d. The hardship is caused by the ordinance because it does not recognize the service road as a street for purposes of determining the number of walls that are allowed wall signage. e. The variance would not be detrimental to the public welfare or injurious to the neighborhood. f. The setback between the wall signs and the lot lines would exceed the ordinance requirements, and therefore would not affect the supply of light and air to neighboring properties. In addition, the proposed wall signage would not diminish property values within the neighborhood. g. In order to provide signage that clearly indicates the proposed use to the traveling public, a wall sign is required along each street. 3. The wall signage proposed for the east wall shall be roughly 10 square feet, and the wall signage proposed for the north wall shall be roughly 20 square feet. There shall be no neon sign band on the building. .4.Prior to issuance of the building permit, the applicant must provide evidence of a-- - - Formatted: Bullets and Numbering recorded parking easement for seven parking spaces at the adjacent Maple Grove Shopping Center. 6-.5.Except for the signage for which a variance was granted, all signage shall comply-- - - Formatted: Bullets and Numbering with the sign regulations of the Zoning Ordinance. 15 6.No alcoholic beverages shall be sold or served on the premises. - Formatted: Bullets and Numbering Resolution 2000-109 (99125) Page 3 7. The operation shall be responsible for litter control within 300 feet of the premises and litter control is to occur on a daily basis. Trash receptacles must be provided at convenient locations on the site to facilitate litter control. 8. This resolution approves a variance to the Fire Code requirement for a fire lane within 50 feet of all sides of the building, pursuant to the conditions listed in the Fire Inspector's Memorandum dated February 7, 2000. 4-7-.9. Standard Conditions: 4 - ---- f Formatted: Bullets and Numbering A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Compliance with the Ordinance regarding fire flow calculations, the location of fire hydrants, fire department connection and fire lane signage. D. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. Compliance with regulations regarding handicapped parking spaces and access. E. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. F. Payment of park dedication fees prior to issuance of building permits. F-:G.This approval shall expire one year after the date of approval, unless the property - -- Formatted: Bullets and Numbering owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 21030.06, and 21045.09 of the Zoning Ordinance.
