RESOLUTION 2000-105
APPROVING THE USE OF ALTERNATIVE WETLAND BUFFERS FOR NORTH
AMERICAN PROPERTIES, INC. FOR PROPERTY LOCATED ON THE NORTHWEST
QUADRANT OF HIGHWAY 55 AND VICKSBURG LANE NORTH (99123)
WHEREAS, North American Properties, Inc. has requested the use of alternative wetland buffers;
and
WHEREAS, the applicant has requested the use of alternative wetland buffers and setbacks as
provided for in the Zoning Ordinance; and
WHEREAS, Section 21670 of the Zoning Ordinance requires the City Council to evaluate the
appropriateness of using alternative wetland standards as part of its review of a sketch plan; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Meeting.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it hereby approves the alternative wetland buffers subject
to the following findings and conditions:
1. The use of alternative buffers is approved in accordance with the plans and application
received by the City on November 5, 1999, except as amended by this resolution.
2. The use of alternative wetland buffers shall not exceed 105 feet of the wetland edge. Standard
buffers shall be provided along the remainder of the wetland.
3. The applicant shall make a good faith effort to examine ways to lessen the wetland impacts
and provide wetland buffers and setbacks during the design of the project.

4. The applicant is encouraged to shift the senior housing building west to further reduce or
perhaps eliminate the need for alternative wetland buffers.
5. This approval shall not preclude the imposition of changes in the project or wetland mitigation
plan that may be identified during the review process.
6. Extraordinary management measures shall consist of 1) extra erosion control measures during
construction and until the site is re -vegetated, 2) wetland vegetation and natural plantings in
the buffer and setback area, 3) the use of phosphorus free fertilizer, and 4) directing all run-off
from buildings, parking lots, and other impervious surface into the storm water pond.
7. No fill shall be placed in the wetland for the creation of buffers.
8. A formal development application consisting of a preliminary plat, rezoning to PUD, PUD
general plan and wetland mitigation plan is required for the proposed project.
