HomeMy WebLinkAboutCity Council Resolution 2000-097CITY OF PLYMOUTH RESOLUTION NO. 2000-097 AUTHORIZING THE VACATION OF A DRAINAGE EASEMENT FOR PONDING LOTS 1 AND 4, BLOCK 1 FERNDALE PLACE WHEREAS, a petition was received to vacate a drainage easement for ponding in Lots 1 and 4, Block 1, Ferndale Place; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for February 15, 2000 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of February 15, 2000; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on February 15, 2000 to inform any and all interested parties relevant to the vacation of a drainage easement in Lots 1 and 4, Block 1, Ferndale Place; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage easement for ponding be vacated: C:ADoc=cnts and Settingsubaird\Local Settings\Temp\CCR 2000-097_65403\CCR 2000-097.doc A perpetual drainage easement for ponding purposes originally dedicated in the recorded plat of Ferndale Place contained within Lots 1 and 4, Block 1, Ferndale Place. Adopted by the City Council on February 15, 2000. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on February 15, 2000, with the original thereof on file in my office, and the same is a correct transcription thereof.
