RESOLUTION No. 2011-346
A RESOLUTION APPROVING AN INTERIM USE PERMIT FOR SUNCREST BUILDERS TO
ALLOW TEMPORARY OCCUPANCY OF AN EXISTING HOME WHILE A NEW HOME IS
CONSTRUCTED, FOR PROPERTY LOCATED AT 12316 OLD ROCKFORD ROAD

WHEREAS, Suncrest Builders has requested an interim use permit for property
located at 12316 Old Rockford Road, legally described as follows:
All that part of the Southwest Quarter of the Northwest Quarter, and the Northwest
Quarter of the Southwest Quarter bounded by a line described as follows: Beginning at a
point 255 feet North of the South line of said Southwest Quarter of the Northwest Quarter
and 1012 feet East of the West line of said Southwest Quarter of the Northwest Quarter,
Section 14; thence East and parallel to the South line of said Southwest Quarter of the
Northwest Quarter to a point 165 feet West of the East line of said Southwest Quarter of
the Northeast Quarter; thence South and parallel with the East line of said Southwest
Quarter of the Northwest Quarter to the centerline of State Highway No. 55 (now known
as County Highway No. 9); thence westerly along said centerline to the intersection of said
centerline of said State Highway No. 55 with a line drawn parallel with the West line of
said Southwest Quarter of the Northwest Quarter and 1012 feet East of the West line of
said Southwest Quarter of the Northwest Quarter measure3d along the south line of said
Southwest Quarter of the Northwest Quarter; thence North and parallel with the West line
of said Northwest Quarter to the point of beginning, all in Section 14, Township 118
North, Range 22 West of the 5"' Principal Meridian.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Suncrest Builders for an interim use permit to allow temporary occupancy of an
existing home while a new home is constricted, subject to the following conditions:
I. This interim use permit allows the applicant to temporarily reside in the existing home
during constriction of a new home on the site, in accordance with the application and
plans received by the city on September 13, 2011, except as may be amended by this
resolution.
2. A building permit must be applied for and secured within 60 days of the date that
this interim use permit is approved.

3. The new home must be completed within 180 days from the date the building
permit is issued.
4. The entire existing (original) home and garage must be removed from the site within
30 days of final building inspection approval for the new home. Such removal work
requires a separate building permit.
5. Prior to issuance of the building permit for the new home:
a. The applicant shall provide the city with a financial guarantee (i.e., letter of credit or
cash deposit) sufficient to cover the cost of the demolition.
b. The applicant shall install silt fence on the property.
c. The applicant shall preserve a minimum of two trees in the front yard or plant two new
trees.
6. Municipal sewer and water service must be provided to the existing home for the
duration of its temporary occupancy.
7. Adjacent paved streets shall be kept free of mud, sand, and silt during constriction.
8. The new home shall comply with all standards specified for the FRD (future restricted
development) zoning district. No variances are granted or implied.
9. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
